A TREATISE CONCERNING POLITICAL ENQUIRY, AND THE LIBERTY OF THE PRESS

New York: Printed by George Forman...for the author, 1800.. 296pp. Antique half calf and marbled boards. Lightly foxed. Light dampstaining to upper corner of first few leaves. Very good. Wortman's book is the foremost expression of American libertarian thinking on freedom of speech in its formative stages, stating more fully than any of his fellow Jeffersonian Democrats the case for freedom of expression. Leonard Levy writes: "Tunis Wortman, a New York lawyer who was prominent in Tammany politics, contributed pre-eminently to the emergence of American libertarianism in his book...It is, in a sense, the book that Jefferson did not write, but should have. Devoid of party polemics and of the characteristically American preoccupation with legal and constitutional problems, it is a work of political philosophy that systematically presents the case for freedom of expression...the outstanding characteristics of the book are its philosophic approach and its absolutist theses." From the premise of the Declaration of Independence that the people have the right to dissolve political bonds, Wortman implied an "unlimited right" for individuals and society to express political opinions. For Wortman, a society interested in furthering knowledge or truth must leave speech "entirely unshackled." He held that open debate furthered the ability of society to arrive at the wisest course of action. He argued that the effect of the Alien and Sedition Acts was self-defeating, since coercion could not suppress thought, but only its expression, and so would inevitably lead to a lack of faith in the government, which he viewed as a worse consequence than any breach of peace. Levy concludes: "Wortman's treatise is surely the pre- eminent American classic, because of its scope, fullness, philosophical approach, masterful marshalling of the facts, and uncompromisingly radical view."         Pianta del Forte Beneventano detto Longone.

1800 circa.

Cooke, Hanwell and Parker, 1800.. 1800, 4to, approximately 265 x 215 mm, 10½ x 8½ inches, parallel text in Arabic and Latin on facing pages, pages: (18), xxxii including Subscriber's list and Abdollatiphi Vita, 1-321, (55) - Appendices and Latin Index, bound in full mottled calf, rebacked to style with gilt rules and gilt lettering, all edges speckled blue. Covers and corners slightly worn, attractive reference library bookplate on front pastedown, small library stamp on title page, another with ink number on verso, just showing through on recto, small brown stain to a few upper margins, occasional very slight foxing, slight browning to inner margin of a few pages towards the end. Binding tight and firm. A very good copy of a work which is scarce in any edition. The Arabian author born in Baghdad (1162-1231) was a celebrated doctor and historian. For a number of years he taught philosophy and medicine at the universities of Cairo and Damascus. In this work which is one of the earliest on Egyptology, he relates what he himself saw and learnt on his travels in Egypt, and is particularly full on the plants of the country; the historical part occupies only the two last chapters. The Arabic manuscript was discovered by the orientalist Edward Pococke in 1665 and published by him in the 1680s. His son, also Edward Pococke translated a small part of it into Latin, and the full translation was eventually published by Professor Joseph White of Oxford in 1788.         JOHN ADAMS, SECOND PRESIDENT OF THE UNITED STATES

[Philadelphia]. 1800.. Stipple engraving, 14 1/2 x 11 inches, matted to 20 x 16 inches. Minor toning and soiling. Very good. Edward Savage (1761-1817) is best known for his portrait of the Washington family, completed in 1795. He worked as a painter and engraver in Philadelphia until 1801, and was also proprietor of the Columbian Gallery, which opened in 1796. This portrait of Adams is the second state of the plate, in which the word "second" has been added to the title and with the attribution reading, "Painted by E. Savage in 1800." Stauffer notes that this plate "may only have been published by Savage, and not engraved by him." Still, a handsome and dignified portrait of America's second president, from a painting by Savage.         [AUTOGRAPH NOTE, SIGNED, BY JOHN MARSHALL AS SECRETARY OF STATE, INSTRUCTING HIS CORRESPONDENT ON HOW TO OBTAIN RECORDS OF A CASE DECIDED BY THE SUPREME COURT]

Washington. July 7, 1800.. [1]pp. on a 6 x 9 3/4 inch sheet. Foxed, else very good. A brief but interesting note in the hand of John Marshall and signed by him a year before he became the fourth Chief Justice of the United States. Though the note relates to the business of the Supreme Court it was actually written by Marshall while he was Secretary of State, less than a month after he assumed that office. Marshall writes to a Mr. Temple: "If you will call at the office of the Prothonotary, I think the officers there will be pleased to show you any record of any case that has been disposed of by the Supreme Court. The case to which you seek access has been decided unanimously." Marshall had been a prominent jurist since the mid-1780s, and in 1798 actually declined his first appointment to the Supreme Court, as an Associate Justice. Despite that he had argued before the Supreme Court, and was clearly well informed as to its workings, as is indicated by this note. This Marshall letter is not listed in THE PAPERS OF JOHN MARSHALL. A nice John Marshall manuscript, relating to the workings and decisions of the Supreme Court.

Ship Passport for the Brig Milford of Baltimore to load at Port Republicain, Santo Domingo, 1800

Port Republicain: 1800 - Bifoloium, printed permit of on recto of first leaf under the masthead of Toussaint Louverture as "Général en Chef de l'Armée de Sain-Domingue", accomplished in manuscript. Lightly browned, separating at the fold, and with creases from old folds, but overall very good. Wood-engraved cartouche of the French Republic with the figure of Liberty, seated on a cannon barrel, laurel wreath in one hand and a staff with Phrygian cap in the other, an orb and sceptre beneath her feet. Ship's passport, issued under the authority of Toussaint Louverture, né Toussaint Bréda, as "Général en Chef de l'Armée de Sain[t]-Domingue", and de facto Governor, in which position he had recently been confirmed by the newly-installed First Consul, Napoleon Bonaparte. Within a year Toussaint had conquered Spanish Santo Domingo against Napoleon's explicit instructions, and, fearful of the restoration of slavery, had promulgated a new constitution confirming his powers without consulting his French masters. Bonaparte's reprisal was rapid, refusing to recognise the constitution he dispatched a 20,000 man force under General Leclerc. After a brief, vicious conflict Toussaint negotiated an amnesty for his generals, and retired to his estates, only to be arrested and deported to France, where he died in prison in April 1803. On his voyage to exile Toussaint remarked to chef de division Capt. Daniel Savary that in overthrowing him "on n'a abattu que le tronc de l'arbre de la liberté des nègres; il repoussera par les racines, parce qu'elles sont profondes et nombreuses [they have felled only the trunk of the tree of liberty for blacks; it will grown again from its numerous and deep roots]" And so it was to be; led by Toussaint's right-hand man Jean-Jacques Desallines, the rebel forces defeated Rochambeau at the Battle of Vertiéres in November 1803, and on 1 January 1804 the island declared independence under the name used by its indigenous people, the Taino, Ayiti or Haïti. Thus ended the only slave rebellion in history to end in the establishment of an independent nation, the first black republic. In 1998 a memorial panel to Toussaint Louverture was installed at the Panthéon in Paris reading; "Combattant de la liberté, artisan de l'abolition de l'esclavage, héros haïtien mort déporté en 1803 [Champion of liberty, architect of the abolition of slavery, Haitian hero died in exile in 1803]". The present document gives permission for the six-gun brig Milford of Baltimore, Captain Littleton Waters, to load her cargo of sugar in five days "without molestation or detention." Signed by Toussaint, with customs stamp; and the ten lines of manuscript in English specifying the terms of the Milford's visit, countersigned by Hugh Cathcart, a Jamaica merchant, and at that time the British agent at Port-au-Prince, and Robert Ritchie, the American consul. The merchants of Baltimore were heavy investors in the trade with Saint-Domingue/Santo Domingo, and during Toussaint's struggle with the French this was to lead to problems, with Jefferson supporting the colonial power, and America's merchantmen going armed - like the Milford - to fend off French privateers enforcing the blockade on ports under rebel control. An interesting and attractive document from Haiti's slave rebellion, Toussaint Louverture's signature is far from common.

Paris - de L'Imprimerie de Baudelot et Eberhart, 1800 Book. Very Good. Hardcover. A smartly bound, scarce exploration intoancient Greek physician of the Age of Pericles, Hippocrates. Volume one. Written in a mixture of both French and Greek. Hippocrates is considered one of the most outstanding figures in the history of medicine. He is referred to as the father of Western medicine in recognition of his lasting contributions to the field as the founder of the Hippocratic School of Medicine. This intellectual school revolutionised medicine in ancient Greece, establishing it as a discipline distinct from other fields that it had traditionally been associated with (notably theurgy and philosophy), thus establishing medicine as a profession.         Fragment of tapa cloth tipped onto old backing with manuscript note "Otaheite Cloth from the bark of Trees"

Tahiti,: circa, 1800.. Small fragment of Tahitian tapa cloth, approximately 55 x 92 mm., tipped onto a note with an old (eighteenth-century?) manuscript note, in an envelope circa 1900. A rare and fragile piece of Tahitian bark-cloth tapa, probably dating from around 1800 based on the style of the tapa, the paper to which it is tipped, and the manuscript note in an old hand which uses the old-fashioned "Otaheite" spelling (the OED suggests that it was largely obsolete by about 1820, and it is certainly true that it was very early recognised - by Johann Forster and others - that the initial "O" was an article in the Tahitian language, not part of the name). It is, therefore, not likely to date from much later than 1820, and is in fact probably pre-1800, meaning that it is from the earliest phase of the collection of Pacific materials. As a result, this tiny fragment is a reminder of the way in which all manner of artefacts and curiosities were traded and compared in the wake of Cook's voyages and the opening of the Pacific. It may never prove possible to work out whose is the old hand-writing - even though it is very distinctive - but tapa was one of the most sought after relics; Georg Forster, for one, is known to have distributed sheets of the material, most of it cut up into little fragments as here, while the larger sheets issued in the famous Alexander Shaw tapa cloth book of 1787, are now usually seen trimmed and with little corners hacked off them by eager early collectors. Indeed, the present piece is not dissimilar to one of the cloths in Shaw: see the copy in the Mitchell collection of the State Library of New South Wales (online record a1179038, p. 36), captioned in that copy "cinnamon coloured bark cloth from Otaheite".The backing sheet is old wove paper, with the manuscript note in an old hand "Otaheite Cloth from the bark of Trees". The great mystery, of course, is whether this sheet could in fact be contemporary with the tapa collected on Cook's third voyage. It must be said that it is certainly possible, not least considering what we know of its interesting later provenance in the eccentric Henri Ledoux collection, which was famed for its exotic autograph material, and which was particularly good on the major French voyagers such as Louis de Freycinet. A later hand has added an indistinct note about "Haiti" which Ledoux, in turn, has crossed out and replaced with the correct "Tahiti". Ledoux has also added his distinctive heart-shaped red stamp, as well as stamping the little envelope in which he preserved it.

[LETTER, SIGNED BY JOHN MARSHALL AS SECRETARY OF STATE, WRITTEN TO TURRELL TUFTS, THE AMERICAN CONSUL IN SURINAM, IN WHICH MARSHALL DISCUSSES THE SOUTH AMERICAN SLAVE TRADE]

Washington. Dec. 19, 1800.. 2pp. plus integral address leaf. Quarto, on a folded folio sheet. Old fold lines. Some wear and minor loss to address leaf. Minor soiling. Very good. In a red half morocco folder, spine gilt. A month before his nomination as Chief Justice, Secretary of State John Marshall writes to Turrell Tufts, the American consul at Surinam, cautioning his diplomatic efforts and commenting on the slave trade in South America. Like Thomas Jefferson and James Madison, John Marshall himself owned slaves. In Marshall's native state of Virginia, slaves had become and integral part of the agricultural- based economy. Marshall, however, detested slavery and publicly declared it an evil, calling for a gradual emancipation. Yet the South, despite growing moral objections, became more and more dependent on slavery and as this letter illustrated, afforded the opportunity for American slave traders to travel to South America in order to purchase slaves from the large coffee and sugar plantations. He writes: "I have received your letter, dated October last, and several others, evincing your zeal and alertness in the service of your country. I should have before acknowledged your attention, but for the belief, founded on your communications, that you would soon leave the Colony. It is highly to be regretted, that the unsettled state of affairs at Surinam, and the disingenuous conduct of some of the persons in authority, should have given you so many occasions of complaint and disgust. In such a situation, whilst with a becoming spirit of firmness and perseverance, you endeavour to repel the wrongs of your Countrymen, you will never lose sight of that respectful manner in your addresses to the Officers of the Government, where you reside from the force of your representations. I do not mean this hint as an admonition, but only as a caution, suggested by the state of the correspondence between you and them. Every thing beyond temperate remonstrance must be left for arrangement between the two governments. "Any instructions applicable to the state of things at Surinam more than the above intimation and your standing instructions are rendered unnecessary, by the manner in which you have executed your office. I will only for the present ask your vigilant attention to detect any of our Citizens engaging directly or indirectly in the slave trade. In every such case, you will make it a duty to transmit to this Department an exact account of every fact in relation to that subject, which may come to your knowledge, to the end that the laws may be enforced against offenders." Turrell Tufts was appointed by President John Adams to the Consulate at Surinam in 1799, and it would seem that it may have been a difficult fit for Tufts, a Medford, Massachusetts native. It is a post that he nevertheless held until 1820, when he returned to his native home to live his life out in gentlemanly fashion. John Marshall served as Secretary of State for a mere eight months before being appointed to the Supreme Court, also by President John Adams. An interesting and insightful letter, highlighting the difficulties in dealing with eager junior officers in the diplomatic corps and Marshall's own desire to keep the slave trade from America's shore.
