GEORGIA SPECULATION UNVEILED; IN TWO NUMBERS.

Hartford:: Printed by Elisha Babcock,. 1797. 39, [1 blank] pp. Disbound and lightly toned, mild wear. Else Very Good. On the Yazoo Land Fraud. The introduction states, "This Pamphlet is an...answer to the 'State of Facts,' published by the Georgia Companies. It contains the outlines of the present state of the Georgia business, and a brief sketch of the arguments on both sides, with such Commentaries as the compass of the work would allow." Georgia's Companies had issued their defense in 1795. See Howes G126. Georgia had granted four land companies the right to buy what later became Mississippi and Alabama, for a half million dollars. Virtually the entire Georgia legislature was bribed. Enraged, Georgia's Crawford-Jackson political faction spearheaded the election of a new legislature the next year which rescinded the grant. A State constitutional amendment ratified the rescission. Bishop says Georgia's land grant is void: in addition to the rampant fraud, Georgia had never acquired title to the lands, which belonged to the resident Creeks, Chickasaws, and Choctaws. But the Companies had nevertheless made many sales of the lands to settlers and speculators. These purchasers, known as the 'Yazoo Claimants', disputed Georgia's rescission. In 1810, after years of litigation, the U.S. Supreme Court decided Fletcher v. Peck, the landmark case construing the Constitution's prohibition on a State's impairment of the obligations of a contract. The Court held unanimously that Georgia's rescission was unconstitutional. FIRST EDITION. Howes B471. Evans 31830. 111 Eberstadt 227. DeRenne 278. Not in Field or Gilcrease-Hargrett.

Appeal to the People of Great Britain. Public Finances

1797 - MORGAN, William. An Appeal to the People of Great Britain, On the Present Alarming State of the Public Finances, and of the Public Credit. London: J. Debrett, 1797. Slim octavo, period-style full green straight-grain morocco gilt; pp. 87. $3200.First edition of William Morgan's fearless attack on the political and economic cost of British policies in "that detestable war" against America, a major work by the first modern actuary, one of "the pioneers of scientific life assurance in England (ODNB) and nephew of British radical Richard Price, "the most influential advocate of American independence" (Howes). Jefferson, who became Vice President the year this work was published, had a first edition in his library.William Morgan "ranks high among the pioneers of scientific life assurance in England" (ODNB). He was the nephew of famed radical Richard Price, "the most influential British advocate of American independence" (Howes P586), and it was Price who encouraged Morgan's appointment as assistant actuary to the Equitable Assurance Society in 1774. On Morgan's swift rise to chief actuary in February 1775, he quickly "became well known as "˜Actuary Morgan,' the man who made the reputation of the Equitable". the intellectual master of political arithmetic and the éminence grise of insurance, the true father of old age pensions" (Harte, in Crabtree Orations, 231). Morgan "was the first to show how to work out complicated benefits, involving several lives, from any mortality table; the first to value the liabilities of a life assurance company and appreciate the meaning of the result; the first to see that, with the valuations in use, a margin of surplus had to be carried forward". the first to set down the available sources of profit and obtain measures for them; the first to keep record of the mortality of a life assurance office, and to notice that there was such a thing as "˜select' mortality. Further than this, he was the first practical administrator of life assurance and a successful man of business" (Elderton, "William Morgan, F.R.S.," 15). This scarce first edition of Morgan's Appeal speaks not only to his mathematical brilliance, but also his fearlessness in attacking Britain for its aggression in the American Revolution, arguing: "the growing extravagance and folly of fourscore years had loaded the nation at the commencement of the American war with a debt of more than 135 million; and at the conclusion of that detestable war, the public burdens had been aggravated with an additional load of 120 million". The bubble has swollen till it has burst, and we are now brought to the edge of a tremendous gulf" (emphasis added; 28, 81). Morgan's home was a popular meeting place for "other radicals associated with Richard Price; John Horne Tooke, Sir Francis Burdett and Thomas Paine were among those who joined the lively gatherings at Stamford Hill". In 1794 when Horne Tooke and others were indicted for treason, Morgan escaped with a warning from the authorities" (ODNB). Three years later Morgan nevertheless issued this warning about the dire economic and political costs of British aggression. Thomas Jefferson, who became America's Vice President the year Morgan's Appeal was published, had a first edition of it in his library. Morgan, who also shared with Joseph Priestley a strong interest in science, is additionally credited as "the first experimenter with X-rays, 110 years before they were brought in 1895 into prominence by Röntgen" (Anderson, "William Morgan and X-Rays," 219). With several full-page tables; Morgan's preface dated in print, "April 8, 1797." Page of publisher's advertisements at rear and on title page verso. Goldsmiths'17046. Kress B3469. Sowerby 2832.         Théorie de la Terre...Seconde Édition, corrigée, et augmentée d'une Minéralogie

Finely engraved frontis. port. of the author & eight folding engraved plates. Five vols. 8vo, fine cont. mottled calf (a few minor defects), flat spines gilt, red morocco lettering pieces on spines. Paris: Maradan, 1797. Second edition, corrected, and enlarged. This edition expands the sections on mineralogy and petrology from two volumes to four. First published in 1795, this is the author's chief work, which enjoyed considerable popularity among his contemporaries; it was founded for the most part on Werner's teachings. "Taking a broad cosmogonical view of creation, Lamétherie regarded the major features of the earth as the result of the combined action of crystallization, moving water, and shifts in the planetary-motion characteristics of the earth."-D.S.B., VII, p. 604. La Métherie (1743-1817), was chief editor of the famous Journal de Physique from 1785 until the year of his death. He wrote a number of important works on mineralogy and was a friend to many of the leading scientists of his time, especially Cuvier. A lovely set. ?         Voyage de La Pérouse autour du Monde... rédigé par M.L.A. Milet-Mureau

Paris: Imprimerie de la Republique, 1797. The world map lightly browned and a few others in the atlas slightly tanned; a few spots but generally in very good condition.. Four volumes, quarto, and folio atlas, with a portrait, 69 maps and plates (21 folding) in the atlas; the text in fine condition on bluish-tinted paper, completely uncut in modern French period-style blue mottled boards with double labels; the atlas in old French quarter calf over original dark green mottled boards. First edition of one of the finest narratives of maritime exploration ever published. This is an unusually clean and attractive set of this great book, with particularly generous margins. In January 1788, two and a half years after their departure from France, La Pérouse's ships sailed into Botany Bay just hours after the settlers under Governor Phillip began the move from Botany Bay to Port Jackson. After their subsequent departure from the Australian east coast they "vanished trackless into blue immensity" (Carlyle); no further trace would be found of the expedition for three decades. La Pérouse's habit of forwarding records whenever he had an opportunity to do so ensured their survival. The first portion of the expedition's records had been forwarded by sea from Macao; the second (Macao to Kamchatka) went overland with de Lesseps, and the final reports went back with British despatches from Botany Bay, the British extending what was then a normal courtesy between the exploring nations. It was from these records that Milet-Mureau, the editor, established the official narrative of the expedition for its publication in this form.It has been remarked that the friendship between the two nations grew in proportion to their distance from home. Certainly the English attitude to La Pérouse seemed natural to Watkin Tench: "during their stay in the port the officers of the two nations had frequent opportunities of testifying their mutual regard by visits and other interchanges of friendship and esteem;" and La Pérouse endeared himself particularly "by the feeling manner in which he always mentioned the name and talents of Captain Cook."As Glyn Williams has characterised it, the French voyage was 'A deliberate réplique française or counter-stroke to Cook's voyages… a follow-up to Cook's third voyage, [with] its instructions a running commentary on what Cook had discovered and left undiscovered…'.Philip Gidley King noted in his journal that the French explorer "informed me that every place where he has touched or been near, he found all the astronomical and nautical works of Captain Cook to be very exact and true, and concluded by saying, 'Enfin, Monsieur Cook a tant fait qu'il ne m'a rien laissé à faire que d'admirer ses oeuvres' ["Captain Cook has done so much that he has left me with nothing to do but admire his achievements'].A voyage despatched in the fullest spirit of the Enlightenment, under the direct orders of the monarch himself, it was intended to complete discoveries and satisfy many different curiosities. La Pérouse was specifically instructed to study climates, native peoples, plants and animals, to collect specimens and artefacts and to observe the activities of other European powers. The official instructions included the requirement that he should 'act with great gentleness and humanity towards the different people whom he will visit'.The timing was remarkable: coincident at its close with the Australian First Fleet, La Pérouse left France in 1785 and never knew of the French Revolution; and while Marie Antoinette chose Cook's voyages to read the night before her death, Louis XVI is said to have repeated on his way to the scaffold the question that he had been asking for months: ''Is there any news of M. de La Pérouse? 'The narrative published here and in subsequent editions and translations covers the progress of the voyage from the departure of the two vessels from Brest in 1785. On their way to the northwest coast of America they stopped in Chile, Easter Island and Hawaii, where they were the first Europeans to land on Maui. During 1786 La Pérouse followed the American coast from their landfall near Mount St Elias in Alaska to southern California, exploring and mapping the coast and making particularly significant visits to Lituya Bay where they transacted with the Tlingit tribe (as dramatised two centuries later by Carl Sagan in Cosmos), the outer islands of British Columbia, San Francisco and Monterey. The first non-Spanish visitor to California since Francis Drake, the French explorer took close note of Spanish activity in the pueblos and missions. The expedition sailed on, visiting Macau, Manila, Korea, the Pacific coast of Russia, Japan, and Samoa and exploring the central Pacific, but their main instructions were to make for Australian waters to check on English activity in the region. On 24 January 1788 they reached Botany Bay.The folio Atlas contains the wonderful series of views chiefly after the original drawings by the chief official artist, Gaspard Duché de Vancy, that had been sent back to France with the various despatches; many of these were recently exhibited at the Musée de la Marine in Paris. Strikingly interpreted as engravings and printed here in rich dark impressions they were, as Christina Ionescu (Book Illustration in the Long Eighteenth Century) has noted, like the engravings in the huge Napoleonic Déscription de l'Egypte, continuing a tradition of "large and extravagant productions" at a time when more commercial publishers were generally downsizing the illustrative content of publications. The Atlas also includes magnificent maps of Russian Asia, Japan, California and the Pacific Northwest Coast with important new data for the then imperfectly known Asiatic side of the Pacific.

Authentic Account of an Embassy. to China

1797 - STAUNTON, George Leonard. An Authentic Account of an Embassy from the King of Great Britain to the Emperor of China". Taken Chiefly from the Papers of His Excellency the Earl of Macartney. London: W. Bulmer for C. Nicol, 1797. Three volumes altogether. Quarto, contemporary full polished brown calf gilt neatly rebacked and recornered, raised bands, black morocco spine labels, marbled endpapers and edges; Elephant folio atlas (17-1/2 by 23-1/2 inches), period-style half polished brown calf, raised bands, black morocco spine labels. $27,000.First edition of this splendidly detailed description of 18th-century China, with engraved frontispiece portraits of the Emperor Tchien Lung and Lord Macartney, a wonderful full-page engraving of the Camellia and 25 additional in-text engravings, together with the Atlas plate volume containing nine large folding charts""among the earliest accurate charts of the interior of China""and 35 folio engravings by William Alexander. A beautiful copy in splendid calf-gilt.The exceptional two quarto volumes and elephant folio Atlas of George Staunton's Account of the British Embassy to China offer a rich "account of the first British embassy to China, under Lord Macartney. Great Britain was anxious to establish formal diplomatic relations with China and thus opened the way for unimpeded trade relations, but centuries of Chinese reserve and self-sufficiency presented a formidable obstacle to the embassy, and the Chinese emperor effectually resisted Lord Macartney's arguments and gifts. The visit of the British embassy nonetheless resulted in this remarkable account of Chinese manners and customs at the close of the 18th century, which was prepared at government expense". Staunton, a friend of Dr. Samuel Johnson and Edmund Burke, was a medical doctor who had lived for many years in Grenada. He was the secretary to Lord Macartney in both India and China, and undertood diplomatic missions to Warren Hastings and to Tipu Sahib at Seringapatem" (Hill 1628). "Apart from its Chinese importance, [Staunton's Account] is of considerable interest owing to the descriptions of the various places en route which were visited, including Madeira, Teneriff, Rio de Janeiro, St. Helena, Tristan d'Acunha, Amsterdam Island, Java, Sumatra, [and] Cochin-China" (Cox I, 344). This important work contains some of the earliest accurate charts of the interior of China and provides many invaluable geographical and cultural observations. The full-page folio engravings, including two of the Great Wall of China, were made after drawings by William Alexander, who accompanied the embassy as junior draughtsman. "This work was remarkably successful. About 15 editions issued in seven European countries and the U.S. from 1797 to 1832" (Lust, 545). This copy is complete, with order of in-text engravings in Volume I occasionally differing from that in "List of Engravings," as issued. Hill 1628. Cordier, 2381-83. Lust, 545. Early owner signatures. Light penciled marginalia to one leaf (Vol. II:23).Text and plates fresh, light expert reinforcement, minor restoration to corners of several Atlas leaves without affecting images. A splendid copy in near-fine condition. [Attributes: First Edition; Hard Cover]

Georgia Speculation Unveiled; In Two Numbers

Hartford: Printed by Elisha Babcock, 1797. First Edition. Wraps. Good. 8vo. 39 pages. Stitched wraps with title page 1. Untrimmed. Light to moderate scattered toning and brown spots. Old clear tape repair and small hole on title page (no loss of text). Remnants of outer wrap on front joint. Dull green strip of linen tape on rear blank joint. The author's statement on the verso of the title page reads, "This pamphlet is an actual, though not a literal answer to the "State of Facts" published by the Georgia Companies (see Howes G 126). It contains the outlines of the present state of Georgia business, and a brief sketch of the arguments on both sides, with such Commentaries as the compass of the work would allow. The general tenor of it, especially that part which treats of the Chancery powers of our Courts, will be found applicable to the cases of all, who have suffered by any kind of Land Speculation." Howes B 471; Evans 31830; DeRenne 278; Sabin 5593. From Wikipedia; The Yazoo land scandal, Yazoo fraud, Yazoo land fraud, or Yazoo land controversy was a massive, real estate fraud perpetrated, in the mid-1790s, by Georgia governor George Mathews[1] and the Georgia General Assembly. Georgia politicians sold large tracts of territory in the Yazoo lands, in what are now portions of the present-day states of Alabama and Mississippi, to political insiders at very low prices in 1794. Although, the law enabling the sales was overturned by reformers the following year, its ability to do so was challenged in the courts, eventually reaching the US Supreme Court. In the landmark decision in Fletcher v. Peck (1810), the Court ruled that the contracts were binding and the state could not retroactively invalidate the earlier land sales. It was one of the first times the Supreme Court had overturned a state law, and it justified many claims for those lands. Some of the lands sold by the state in 1794 had been shortly thereafter resold to innocent third parties, greatly complicating the litigation. In 1802, because of the ongoing controversy, Georgia ceded all of its claims[2] to lands west of its modern border, to the U.S. government, in exchange for which the government paid cash and assumed the legal liabilities. Claims involving the land purchases were not fully resolved until legislation passed in 1814 established a claims-resolution fund. The Yazoo land fraud is often conflated with the Pine Barrens speculation, another land scandal which took place in east Georgia at about the same time. In this case, the state's high-ranking officials were making multiple gifts of land grants for the same parcels, resulting in the issuance of grants totaling much more land than was available in the state of Georgia.

TO HIS EXCELLENCY THOMAS MIFFLIN ESQUIRE, GOVERNOR OF THE COMMONWEALTH OF PENNSYLVANIA. THE PETITION OF JOHN HYTON OF STRASBURG TOWNSHIP IN THE COUNTY OF LANCASTER. HUMBLY SHEWETH... YOUR PETITIONER'S WIFE HATH BEEN FOUND GUILTY OF HORSE STEALING AND SENTENCED TO ONE MONTHS IMPRISONMENT AND TO PAY A FINE OF SIXTY DOLLARS FOR THE USE OF THE STATE. THAT YOUR PETITIONER IS VERY POOR AND IN DISTRESSING CIRCUMSTANCES AND UNABLE TO PAY THE SAID FINE, HAVING ALSO THREE SMALL CHILDREN WHO DEPEND UPON YOUR PETITIONERS DAILY LABOUR FOR THEIR SCANTY SUBSISTENCE. YOUR PETITIONER THEREFORE HUMBLY PRAYS THAT YOUR EXCELLENCY TAKING HIS DEPLORABLE SITUATION INTO CONSIDERATION MAY BE PLEASED TO REMIT THE SAID FINE...

[Lancaster, PA:. 1797]. [1], [2 blanks], [1- docket, with Governor Mifflin's signature approving the petition]. Manuscript petition, written in ink on a single page, with the names and signatures of ten townspeople endorsing the petition. One leaf. Old folds with a few short splits but Very Good. Elizabeth Hyton was convicted of horse stealing "on the last Monday of February Anno Domini 1797." Governor Mifflin pardoned her on March 27, 1797, when her one-month jail sentence expired. Fortunately for Elizabeth and her impoverished family, Pennsylvania did not consider horse theft a capital crime, unlike some States. In 1786 Pennsylvania became the first State to adopt discretionary terms of hard labor and imprisonment for felony offenses, and to delegate to judges rather than juries the authority to determine the sentence. "The frequency with which felons were pardoned may be surprising to those familiar with modern clemency practices. Pardon and benefit of clergy were alternative and ameliorative features of what was otherwise a horribly draconian penal system." King, 'The Origins of Felony Jury Sentencing in the U.S.' 78 Chicago-Kent Law Review No. 3, pages 937, 949 [2003] [noting the dramatic rise in pardons for horse-stealing in 18th century Virginia, when it was rendered a capital crime].

Engraved medallion port. of the collector on title. 32, [468] pp. 8vo, modern half-calf & paste-paper boards, spine gilt, red morocco lettering piece on spine. Paris: J.L. Nyon l'aîné, 1797. The sale catalogue of the vast library, especially rich in natural history, formed by one of the outstanding figures of 18th-century France. Lamoignon-Malesherbes (1721-94), born into one of the great legal families, was the son of Guillaume de Lamoignon, Chancellor of France, who entrusted his son with the control of the press which he exercised in the most liberal manner: Grimm asserted that without his assistance the Encyclopédie would probably never have been published. Malesherbes was an influential spokesman for freedom of the press, religious toleration, and tax reform. Having been twice minister of the "Maison du Roi," he retired to his country seat, but in 1792 volunteered to defend Louis XVI before the Convention. Accused of having defended the king and of other "acts of treason," Malesherbes was guillotined, after being forced to witness the execution of his entire family. This sale of 7413 lots reflect Malesherbes's intense interest in agronomy, botany, and natural history in general. Fine copy. Although the title page and last leaf promise an author's index, this was never published. From the library of A.R.A. Hobson with bookplate. ? D.S.B., IX, pp. 53-55. Grolier Club, Printed Catalogues of French Books Auctions…1643-1830, 369. Guigard, II, pp. 281-82. AUTOGRAPH LETTER, SIGNED, FROM CHARLES COTESWORTH PINCKNEY TO FULWAR SKIPWITH, RELAYING INFORMATION FROM THE EMPEROR OF RUSSIA RELATIVE TO AMERICAN SHIPPING].

Amsterdam. March 6, 1797. - [1]p. plus integral address leaf. Quarto, on a folded folio sheet. Old folds. Small loss from wax seal, repaired; affecting a few words of marginal postscript. Some light soiling and foxing. About very good. In a folio-sized brown half morocco and cloth clamshell case, spine gilt. Charles Cotesworth Pinckney - signer of the Constitution, Founding Father, twice presidential candidate, and President General of the Society of Cincinnati - writes to the U.S. Consul General in France, Fulwar Skipwith, concerning orders he has received from the Russian emperor regarding the shipping of French liquors to Russia. Skipwith served as Consul General for several years and was integral in negotiating the Louisiana Purchase. Pinckney writes from the Netherlands where he awaits further orders from the U.S. government after being expelled from France, where he was serving as U.S. Minister. The French, highly displeased with the results of Jay's Treaty which the U.S. made with Britain, threatened to imprison Pinckney and evicted him from the country. Pinckney writes: "Sir, I have just received authentic information of the enclosed orders of the Emperor of Russia relative to the importation of the wines & brandies of France in neutral vessels into his territories. As these orders may prove of considerable importance to such of our fellow citizens in France as are concerned in shipping, you will be pleased to communicate them to our consuls, vice consuls & consular agents in that Republic, that our countrymen may be made acquainted with them." Charles Cotesworth Pinckney (1745-1825) was a South Carolina politician and army officer who rose to the rank of brigadier general in the American Revolution. After the war he set about rebuilding his plantations and fortunes. Elected to the Constitutional Convention in 1787, he signed the U.S. Constitution (as did his cousin, Charles Pinckney), and worked to have the document ratified by his state. Though he turned down several government appointments to pursue his personal affairs, Pinckney did accept a position as Minister to France, which he held only briefly, arriving in December 1796 and leaving in January 1797. Expelled by an indignant French government, angry over the Jay Treaty, Pinckney returned to Paris in September 1797 with Elbridge Gerry and John Marshall to negotiate. He left in April 1798, outraged that the French had tried to extort bribes from the commission. He ran twice as a Federalist candidate for president, in 1804 and 1808, but was elected neither time. From 1805 until his death in 1825 he was President- General of the Society of Cincinnati. A good letter from this Founding Father, concerning diplomatic affairs in France. This letter sold for $475 at Sotheby's in 1978.

Stamperia Gesiniana (poi Olzati) 1797-98, Genova - In 8, pp. 208; 124. Cart. coeva. Marca tipografica xilografica a pagina VIII e all’ultima pagina.

        Log of HMS Centaur, 1808-1810.

6/25/16. Folio, unpaginated. About 200 pp. "HMS Centaur" was a 74-gun third rate launched in 1797. During her 22-year career she saw action in the Mediterranean, the Channel, the West Indies, and the Baltic, fighting the French, the Dutch, the Danes and the Russians. She was broken up in 1819. This log begins in September 1808, immediately after "Centaur's" engagement with the Russians in the Gulf of Finland during the Anglo-Russian War. Entries record her repairs, provisioning, events aboard ship (including floggings and other disciplinary actions), and movements within the squadron - the British were acti9vely engaged in fighting the Russians, and there is much scurrying about - leading up to the bombardment of Flushing in August 1809. This was also the year in which midshipman Frederick Marryat joined the ship's company. He is supposed to have saved the life of a shipmate by leaping into the sea to rescue him, and this log records several instances in which Marryat might have performed this feat, such as this entry from August 23, "Sent Jno Coleman to the Hospital, he having broke his legs by a fall from the fore yard." Legibly written in several different hands, on fine heavy paper. Bound in later quarter leather over boards.

1797. Large 8vo. (4), 207, (1) pp. With 20 folding engr. plates of musical notes. (Bound with) II: Asioli, B[onifacio]. Mailand, (Carlo Dova for) Giovanni Ricordi, [1811]. 49, (3) pp. With 3 folding engr. plates of musical notes. Contemp. half calf with giltstamped title to spine. Second edition of this splendid instructional work (first published by Zerletti in 1775). Treats the entire field of singing technique, common musical ornaments and instrumental flourishes, and the rules of accompaniment and harmonization. In addition, Manfredini provides advice on how to interpret certain pieces (cf. MGG). V. Manfredini (1737-99) had been Kapellmeister of Empress Katharine II and teacher of her son Paul before retiring to Bologna in 1768, where he wrote his present chief theoretical work. His views on voice instruction drew severe criticism from Mancini. "The second edition (Venice, 1797) was much revised and enlarged with new sections on singing and counterpoint" (New Grove). - Bound with the undated "seconda edizione" of Asioli's principal instructional work, the "Principi elementari de musica" (first published in Milan in 1809). Asioli enjoyed a great teaching reputation; Mozart's son was among his students. Next to Simon Mayr, Asioli was regarded as one of the foremost masters in Italy. His writings on musical theory and methodology remained influential throughout most of the 19th century (cf. MGG I, 753f.). Rare in all editions; no copy at auctions since 1950. - Spine somewhat rubbed; interior slightly browned due to paper. Altogether a fine sammelband containing two important works of theoretical and practical musical instruction. I: Hirsch I, 343. Eitner VI, 299. New Grove XI, 615. MGG VIII, 1580.
