Observations concerning the Distinction of Ranks in Society.

London: Printed by W. and J. Richardson, for John Murray,, 1771. Quarto (259 × 203 mm). Recently rebound to style in speckled half calf and marbled boards, spine ruled gilt in compartments, red morocco label, endpapers renewed to style. Ownership inscription on title page of "William Sergeant, August 20 1800", possibly an attorney of that name practising in the Supreme Court of the State of Pennsylvania from 1796. Old stains to fore-edge (affecting the blank margins of a number of gatherings) otherwise a good tall copy with the half-title and terminal advertisement leaf. First edition. Observations concerning the distinction of ranks in society, Millar's most important work, is one of the earliest and finest examples of an empirical approach to sociology. "Of a remarkably liberal tone, Millar's study of social rank covers class distinction, the history and condition of women, primitive society, and the relationship between parent and child, and master and servant" (J. S. German, Voices of Scotland: A catalogue of an exhibition of Scottish books and manuscripts from the 15th to the 20th centuries, The Grolier Club 1992, p. 67). The influence of Montesquieu and, particularly, of Hume's The Populousness of Ancient Nations is evident. Millar was a supporter of the American cause and an opponent of slavery; both feature in the final chapter, "Of the condition of servants in different parts of the world". Born in Lanarkshire the son of the local minister, Millar (1735?1801) "studied law at Glasgow, where he was an intimate of James Watt (1736?1819), the inventor of the steam engine, and where he attended the lectures of Adam Smith. After completion of his studies, Millar spent two years with Lord Kames's family (through whom he met David Hume). Millar became a proponent of Hume's metaphysical doctrine and, though they were politically opposed, Hume placed his nephew under Millar's charge. Adam Smith also showed his esteem by sending his cousin to study under Millar" (ibid.).

An Introduction to the History of Great Britain and Ireland.

      - London: Printed for T. Becket and P.A. De Hondt, in the Strand, MDCCLXXI [1771]. 4to, (viii), 291, (9), (1, ads) pp. Original mottled calf, rebacked preserving much of the elaborately paneled backstrip and black morocco label, marbled endpapers. Calf worn, title page foxed, but the whole sound and the pages generally clean and bright with only occasional foxing. Old signature on endpaper, armorial bookplate of James Walnyn. First edition. Published when Macpherson was in his mid-30s and largely withdrawn from the storm his Ossian translations had provoked, the work inevitably has a strong Celtic tilt, focussing almost entirely on pre-Roman times and ending with the rise of the Anglo-Saxons. He takes considerable care to discuss the origins of the ancient Britons, Scots and Irish, and to refute such theories as "the Spanish extraction of the Irish" and the Irish extraction of the Scots. Later chapters discuss the religion, recreations, language, and government of the ancient British nations. An Irish edition was published in the same year and enlarged editions appeared in 1772 and 1773. The later editions are much more commonly seen -- we can find just one auction record for the first edition (Bonham's 2006). Macpherson's Ossianic works had a considerable influence on William Blake, both their spirit and style (see Pierre Berger, 1914, 373-375pp.) and it is not unlikely Blake read this work also.         The apology of Benjamin Ben Mordecai to his friends, for embracing Christianity; in seven letters...

London: J. Wilkie 4to (26.5 cm, 10.4"). vii, [1], 128, [2], v, [1], 60, lxiii–lxv, [1], 63–115, [1], cxxi–cxxiv, 125–205, [1], v, [1], 48, xlix/l, 49–94, xcv–xcvii, [1], 95–187, [1 (adv.)] pp.. 1771–74 First edition. The ostensible conversion of the title was actually an excuse to attack the Athanasian creed; written by the controversialist Rev. Henry Taylor and addressed to Elisha Levi, these letters "espoused the restrained Arianism of Samuel Clarke . . . and embraced the Apollinarian heresy which questioned the human nature of Christ's person" (DNB). Letters II–IV and V–VII have separate title-pages, dated 1773 and 1774 respectively. Recent quarter calf with marbled paper–covered sides, leather edges tooled in blind, spine with gilt-stamped leather title-label and gilt-stamped decorations in compartments. Outer (closed) edges institutionally rubber-stamped; title-page and one other pressure-stamped in an old style. => Very clean and with wide margins.

Desnos, 1771. Folio (437 x 285mm). pp. (20), 69, with engraved folded frontispiece and 69 fine engraved plates. Contemporary green half calf, spine with gilt ornaments and gilt lettering, marbled sides (head of spine rubbed). The Buch'oz edition of Merian's famous work on the insects of Surinam and Europe which covers the first 2 volumes of Buch'oz compilation and not present here. The here offered third volume is excessively rare and is a reissue of Rabel's 'Theatrum florae', first published in 1622. The original plates were used for this edition, however without their captions. The text to this work was supplied by Buch'oz. "This book printed in Paris in 1622 by Nicolas de Mathonière, was the second engraved florilegium to be published in France, the 'Jardin du Roy' of Pierre Vallet having appeared in 1608. Published anonymously, 'Theatrum florae' was an immediate success, and further editions were printed… The plates in 'Theatrum florae' are indeed magnificent. Illustrating a variety of flowers, mostly bulbous species (such as fritillary, lily and narcissus), and certain oddities greatly prized during the early part of the century, such as double and multiple blooms forced by the use of 'secret' fertilizers, the specimens have been elegantly arranged and presented on the page… While the images clearly owe much to the earlier florilegia of Vallet and de Bry, certain illustrations stand out due to their exceptional artistic quality and almost scientific realism…" (Tomasi. An Oak Spring flora pp. 70-71). A separate printed title to the present work was not issued, and instead of this the printed title to the first volume the insects of Surinam is bound in on which the title of the third volume is clearly mentioned. Added is also the beautiful engraved folded frontispiece which belongs to the insects of Surinam. A fine copy of this rare work with fine impressions of the plates.//Great Flowers Books p. 67.

1771 - Paris, Imprimerie Didot, 1771. (Polak, 592). TRÈS BEL EXEMPLAIRE, d'une remarquable fraîcheur. FINE COPY. PICTURES AND MORE DETAILS ON REQUEST. [Attributes: First Edition; Signed Copy; Hard Cover]

A clean copy of a Rare Pacific voyage publication. The First English edition of Bougainville's 1763 very significant private expedition to found a colony on the Falklands, on which Antoine Pernety, a Benedictine monk, sailed as secretary. This account is a translation Pernety's journals. France named the islands the Malouines for her ships and men that hailed from St. Malo, and Bougainville used that name when he planted the French flag at Port Louis in 1764. Bougainville commissioned the frigate "l'Aigle" and the corvette "le Spinx" to be built for this self-funded expedition. The settlement was protested by Spain, and the French Government surrendered it to them on condition of their indemnifying Bougainville. Commodore Byron of the "Dolphin" repeated the formalities of claiming the islands for Britain the following year by planting her flag at Port Egmont, Falkland Islands. Cox II, p. 282; Hill 1327. Instruction de Sa Majeste Imperiale Catherine II. pour la Commission Chargee de Dresser le Projet d'un Nouveau Code de Loix. Amsterdam: Chez Marc Michel Rey, 1771. [vii], 229 pp. Frontispiece engraved copperplate medallion portrait of Catherine II by C.A. Boily. Octavo (7-3/4" x 4-3/4"). Contemporary mottled calf, blind rules to boards, gilt spine with lettering piece, edges rouged, marbled endpapers. A few minor scuffs to boards, moderate rubbing to extremities, spine ends worn, front joint starting at ends, corners bumped and somewhat worn. Light toning to text, dampstaining and light foxing to a few leaves, internally clean. An attractive copy. * Second Dutch edition. This important text, also known as the Nakaz, or Instruction, is a statement of legal principles written by Catherine II from 1764 and 1766. Permeated with the ideas of the French Enlightenment, and copied mostly from the work of Voltaire, Montesquieu and Beccaria, it was compiled as a guide for the All-Russia Legislative Commission convened by the Empress in 1767 to create a new code to replace the 1649 Muscovite Code. Revised in consultation with Beccaria, Frederick the Great and Voltaire, the Instruction proclaimed the equality of all men before the law and disapproved of death penalty and torture. Unfortunately, her proposed code was never completed. Catherine's manuscript was written in French, and she later produced a Russian translation. Editions in German and Russian were published in Moscow in 1767. Several editions followed in nations ranging from Itay to Latvia. The first Dutch edition, in Dutch translation, was published in Amsterdam in 1769. The 1771 Amsterdam edition was the first Dutch edition in French. It is a scarce imprint. OCLC locates 2 copies in North American law libraries (Library of Congress, UC-Berkeley). Butler, The Nakaz of Catherine the Great 528 (entry 28). [Attributes: First Edition; Hard Cover]

American Swallow (Chimney Swift) with Wood Lily

London: printed for Benjamin White, 1771. Hand-coloured copper engraving, on fine laid paper. Very good condition. A fine image from Catesby's 'The Natural History of Carolina, Florida, and the Bahama Islands', "the most famous colour-plate book of American plant and animal life...a fundamental and original work for the study of American species" (Hunt). Commonly found in southern Canada and the United States, the American swallow or common chimney swift belongs to the Apodidae bird family. The species dates back to colonial times, when it was then known as the chimney nester. Insects are its primarily sustenance, and it generally nests in hollow trees or chimneys as depicted in this fine plate. The chimney swift is a migratory bird and during the winter, it travels to South America. In his accompanying text, Catesby comments that the "singularity of this bird is, that the shafts of the tails feathers are very stiff, sharp-pointed and bare of feathers at their ends, which seem designed by nature for the support of their bodies, while they are in an erect posture, building their nests, which they do in chimneys, with little sticks interwoven and cemented together in a kind of glue or gum..." (Feduccia, Catesby's Birds of Colonial America (1985), pp. 77-78) In this stunning print, the American swallow is pictured alongside the wood lily (Lilium philadelphicum), with which it is rarely found in nature. Trained as a botanist, Catesby travelled to Virginia in 1712 and remained there for seven years, sending back to England collections of plants and seeds. With the encouragement of Sir Hans Sloane and others, Catesby returned to America in 1722 to seek materials for his 'Natural History'; he travelled extensively in Carolina, Georgia, Florida, and the Bahamas, sending back further specimens. His preface provides a lengthy account of the development of this work, including his decision to study with Joseph Goupy in order to learn to etch his plates himself to ensure accuracy and economy. A lovely and important work, embodying the most impressive record made during the colonial period of the natural history of an American colony. The most significant work of American natural history before Audubon's Birds of America . Cf.

[1] f., 217, [1] p.. 1771 Only edition. This official declaration of the Order of the Immaculate Conception of the convent Jesus Maria of Mexico encompasses a historical synopsis of the foundation and progress of that monastery and ten chapters on the => the religious life of the sisters — their vow of poverty in history and practice; admission into the monastery; and the necessary approval of the Royal Court to implement reforms, according to the rules set forth by Frai Payo Enriquez de Rivera, O.S.A. (1622–84, appointed Archbishop of Mexico in 1668). The document is addressed to the fourth provincial council, called by Archbishop Lorenzana, and is a plea on behalf of the nuns to not change how things are done and administered in the nunnery, to not introduce innovations. Guatemalan by birth, Guevara (d. 1804) studied civil and canonical jurisprudence at the Tridentine Seminary in Mexico, where he graduated from the university and became a lawyer at the royal court. One of the => leading lawyers in Mexico, he ascended quickly to high office, and was appointed governor in absence of the viceroy four times; according to Beristain, he was called the "American Ulpian" (after the Roman jurist) by at least one contemporary. Recent marbled paper over boards, title and author gilt on green leather spine label, new endpapers. Short, shallow instance of insect gnawing at fore-edge of first ten leaves and very limited, minor worming throughout along with mild to moderate mostly marginal speckles of foxing; light waterstaining at fore-edge of some pages and occasional inkstains or smudges; one corner of textblock bumped or "creased across" (with no tearing) and another corner just bumped. A copy not "fine" but definitely worth having.

John Thomas Batt, executorship diary from May 18, 1771 to October 3, 1771 regarding George Montagu-Dunk, 2nd Earl of Halifax

[London]: John Thomas Batt, 1771. 1st Edition. . A small 3-3/4 x 5-7/8 inches [30pp.] manuscript notebook devoted to J.T. Batt's executorship of the 2nd Earl Halifax dated 1771. (covering from May 18, 1771 - October 3 1771). Notebook supplied by 'Robert Thatcher Stationer, on Dukes Court, near St Martin's Court, London. Sells all Sorts of Stationary, Bibles, Common Prayers &c at the Lowest Prices' (label on front pastedown). Limp roan, paper-backed covers; unlined paper (vertical chainlines) interleaved with purple blotting paper. George Montagu-Dunk, 2nd Earl of Halifax, KG, PC was a British statesman of the Georgian era. Due to his success in extending American commerce he became known as "father of the colonies". President of the Board of Trade 1748-61, he aided the foundation of Nova Scotia, 1749, the capital Halifax being named after him. This a manuscript account of the death and its aftermath of George MontaguDunk, 2nd Earl of Halifax. This account is written in the from a diary kept by Halifax's lawyer and executor, John Thomas Batt, who has filled this notebook with details of his efforts to keep Halifax's rapacious mistress at bay and the epic burning of papers at the late Earl's various house.  Bit part players include Lord Hinchingbrooke (First Lord of the Admiralty),  Sir George Osborn, and General Johnson. Batt begins his diary with an account of one of the last suppers he enjoyed with his ailing friend George Montagu Dunk, 2nd Earl of Halifax, known as 'father of the colonies' for his success in fostering American trade and founding Halifax, Nova Scotia while serving as President of the Board of Trade. The diarist reports that George III's physician Dr Noah Thomas was also in attendance at Green House, Bushey Park (now known as Hampton Court House) where Batt describes Halifax as 'very ill, languid, low in spirits... seemed not to relish Company tho Glad to see us.' After receiving several ever more despairing news of Halifax's declining health the long awaited confirmation arrives on Saturday June 8th via Halifax's mistress: ''Mrs Donaldson's footman brought me a verbal message from her that Lord Halifax died at four'. Halifax had a reputation for extravagance and the post mortem ordered by his relatives did indeed suggest that he drank himself to death: 'all the intestines were sound except the liver which was decayed and petrified and the undoubted cause of his death.' Batt details the arrangements for his funeral at the family seat at Horton in Northamptonshire a week after his death. The meat of the diary comes in the battle with the late Earl's mistress Anna Maria Donaldson for control over his posthumous affairs. Amongst 'much discourse' between the lawyer and the mistress who acknowledges 'the bad condition he had left them [his financial affairs] in' Batt encounters a fearsome adversary. A former opera singer, Mrs Anna Maria Donaldson had been Halifax's mistress since at least the 1750s when he built Green House for her, she bore Halifax a daughter and reveals herself here as utterly determined not to lose her hard won privileges as maîtresse-en-titre.As an opening gambit 'Mrs D told me there were three original wills... she asked me whether it was necessary to produce hers... she said there was a codicil to hers not with the rest.' Batt responds deadpan:  'That circumstance Madam is an additional reason to produce it.' With Mrs Donaldson safely isolated in an upstairs the rooms the rival wills are read in the presence of Lord Hinchinbrooke (First Lord of the Admiralty, responsible for British Navy during American War Independence), Sir George Osborn, [Edward] Sedgwick (secretary) and General Johnson. As the legal process unfolds Batt attempts to secure Halifax's properties and their contents. He describes a visit to Horton on October 2nd: 'made further progress with Papers - particularly a large library writing table with Drawers - in which were many Letters of private friends as long since as the year 1742, 1743.... burnt all the letters particularly a draw full on the election of Northamptonshire when Mr Hanbury's interest was espoused by Lord Halifax'. Staff are paid off and occasional gifts dispersed including to 'Sir Robert Throgmorton having expres'd a desire to have a wooden image of an American Indian and a skin of a Zebra stuffed - I consented.' Meanwhile Mrs Donaldson makes a mockery of Batt's attempt to disperse Halifax's estate in a controlled way, making off with jewels, saying 'she had them; that Lord Halifax has given them to her the night before he last went to Bushey.' After considering laying criminal charges Batt and his team 'agreed to leave out the charges ag't Mrs D as she had given up the jewels readily and tho we cou'd alledge embezzlements we cou'd no prove them.'  Thwarted by Batt on this front, Mrs Donaldson 'desired leave to remove her wearing apparel from Grosvenor Square. She came there July 9... and removed according to Mrs Newlands' account 13 Boxes and Packages. This alarmed us.' In mitigation she informs Lord Orwell that 'on her word and credit they contained nothing but Apparel of hers and the child's. Credat Judeus.' Applying pressure through her lawyer, Batt plays hard ball and 'refused unless she would Prove them or give us Security for the value - this she cou'd not do.'The diary breaks off before probate has been awarded in early October of 1771. Halifax left no legitimate children and his titles became extinct on his death. The house that he built for Mrs Donaldson still stands and is now a private school and wedding venue. This diary comes from a collection of John Thomas Batt's papers. He was an upmarket lawyer who knew everyone in late eighteenth century London, served in the Rockingham alliance and was close to Edward Gibbon. The diary is classic Batt in that it is an account of his friendship with the dying Lord Halifax that spills over into his professional life as a lawyer.John Thomas Batt of London and New Hall, Downton (1746-1831) was a successful lawyer dealing with the most prominent families of the late eighteenth century, friend and confidant to many of the notable figures of the day, including Lord Halifax and Edward Gibbon (for whom he acted as executor), the younger Pitt and James Harris, the musical patron.         Prickly Apple and Zebra Swallow-Tail

London: printed for Benjamin White, 1771. Hand-coloured copper engraving, on fine laid paper. Very good condition apart from some very light soiling and mild rippling. A fine image from Catesby's 'The Natural History of Carolina, Florida, and the Bahama Islands', "the most famous colour-plate book of American plant and animal life...a fundamental and original work for the study of American species" (Hunt). Otherwise known as the lily thorn or thorny Catesbaea, the prickly apple grows in tropical North America and the West Indies. It was discovered by Catesby in the Bahamas, near Nassau. As pictured in this stunning print, this beautiful plant yields fruit and colourful cone-shaped flowers. Flying amidst its branches are two examples of the large North American zebra swallow-tail butterfly, so called because of the distinctive zebra-like markings on its wings. They typically inhabit open fields and woodlands and have conspicuously long graceful tails.
