Thomas Hutchinson
Thomas and John Fleet, Boston, MA, 1764. FIRST EDITION. [6], iv, 566 pp. Hardcover in contemporary cloth with red leather spine and gilt title label on spine. Age toning and minor foxing throughout the text. "Hutchinson did not seek his role as an ally of the Crown. Rather, he was a vigorous and conventional defender of Massachusetts interests. He opposed, for example, the impressment of Massachusetts inhabitants by British naval vessels. In 1742 he confronted Captain William Scott on the deck of H.M.S. Astraea and demanded the release of one seaman and the hostage wife of a man Scott was attempting to impress. Hutchinson persuaded Shirley to intervene in their behalf. In 1747 Speaker Hutchinson mediated between a violent anti-impressment mob and the provincial government; the Massachusetts House approved such a strong anti-impressment resolution that the mob dispersed. Hutchinson's History of Massachusetts-Bay accurately recounted these events and contained sympathetic accounts of Puritanism; the Antinomian heresy of Hutchinson's ancestor, Anne Hutchinson; and Massachusetts opposition in the 1680s to the "tyrannical disposition" of the royalist governor, Sir Edmund Andros, and his administration's "harpies." Hutchinson's History acknowledged the multiplicity of jostling interest groups in Massachusetts and the duty of government to protect the public interest from the demands of self-interested groups like the advocates of an inflated money supply he had battled in the 1740s. Though Benjamin Franklin (1706-1790) got credit for the Albany Plan of colonial union in 1754, Hut … [Click Below for Full Description]

[New York Colonial Jury Trial ]
New York: Printed by John Holt, 1764. 4to. [2], iv, 68 pp, with the half title, as issued. Front free marbled endpaper loose. Bound in 19th century half brown morocco [bookplate of Bar Assn of the City of NY, gift of George L. Ingraham (1847-1931), New York City lawyer and judge], some rubbing. Ownership signature of Nathan Sanford [1777-1838], prominent New York City lawyer and perennial politician. Institutional rubberstamp and accession number, mostly in margins of title; Very Good. This is a rare imprint of an important case, asserting the primacy of the jury system in colonial America against official British meddling with American judicial deliberations. Publication was prompted by the desire to drive home to New Yorkers "the pernicious Consequences" of British interference with local juries "by a Method entirely new, unconstitutional and illegal." Forsey had sued Cunningham for an assault and battery; a jury of their peers found for Forsey and assessed damages against Cunningham. Unhappy with the large amount of damages, Cunningham sought an appeal. He did not claim that the trial court committed any errors of law; he simply argued that the jury had misconstrued the facts. Allowing the appeal would have diminished the role of the jury in favor of appellate judges' assertions of their royal prerogatives. Nevertheless, Lieutenant Governor Cadwalader Colden permitted Cunningham to appeal. New Yorkers in 1764, already angered by British control of local affairs, found this interference with the role of the jury intolerable. They challenged Colden's decision … [Click Below for Full Description]

Charles Nicolas COCHIN
Etching with engravings, signed and dated at lower center. A good impression, printed on contemporary laid paper, with margins, some expert repairs at the back, otherwise in good condition. This plate is engraved by Cochin & Jacques Philippe Le Bas, after a painting by Joseph Vernet. Vernet was commissioned by Louis XV in 1753 to paint fifteen views of the main ports of France, and given the exceptional title of "peintre des marines de sa majesté". He spent twelve years travelling around the Mediterranean, Atlantic and Channel coasts with his family and servants in tow. The country was at war with England at the time, and Loui … [Click Below for Full Description]

[Click Below for Full Description]
