      1742 - (MASSACHUSETTS ACTS AND LAWS). The Charter Granted by Their Majesties King William and Queen Mary to the Inhabitants of the Province of the Massachusetts-Bay in New-England. WITH: Acts and Laws of His Majesty's Province of the Massachusetts-Bay in New-England. Boston: Samuel Kneeland and Timothy Green, 1742. Folio, modern full dark red calf, raised bands. $4800.Scarce colonial printing of the charter and laws within the Massachusetts Bay province, one of the earliest and subsequently most rebellious of British colonies. Handsomely bound."Considerable mystery surrounds the grant of the charter to the Massachusetts Bay Company in 1629. The enemies of the colony later insisted that it was gotten surreptitiously, and there are some grounds for suspecting that bribery was involved. In any event". its charter was that of a trading company much like that given to the Virginia Company in 1612". Despite legislation and the multiplication of administrative agencies and offices, the colonies were never brought under effective control for any length of time. After 1660, Massachusetts provided a center of resistance". Other colonies likewise opposed efforts at control, but none in this period were so strenuous as Massachusetts". [and] the Massachusetts Bay charter of 1629 was vacated in 1684. The Dominion of New England wiped out the legislatures of the New England colonies and substituted for them a royal governor and council who were given the power to rule without consulting the inhabitants". When Massachusetts got a new charter in 1691, the colony's independence was limited by the addition of a royal governor and royal officials". While, in the strictest sense, no government could exist in the colonies without a grant from the Crown, there did exist in the colonies from the start a concept and a practice which assumed that there was a more basic foundation of society and government than that offered by grants from higher authority". As the colonies grew, there was ever more evidence of growing self-consciousness and of an insistence that the colonies had "˜rights' ". Implicit in these is the assumption that the "˜rights' of Englishmen are inherent rights, not a gift from higher authority" (Jensen, 61-64, 234,184). In addition to representing America's course toward independence, this is an early and scarce imprint with fascinating insights into colonial and British concerns, including relations with Indians, "Free Negroes," laws on taxing and the regulation of militia, as well as those concerning prisons, trials, tradesmen, piracy, sexuality, "misspending money in taverns," adultery, polygamy and many other topics. Copies of the Acts vary in collation, since after each legislative session additional laws were printed and paged continuously with the expectation that they would be bound with the original work. A complete copy can contain anywhere from 333 to more than 550 pages. Here, the final pages-335-337-"contain the last session of the General Court of 1742-43" (Tower 262). The Charter usually appears at the beginning of the 1742 printing, as in this copy; though the Charter and Laws are separate books, they are almost always bound together. Evans 5002; 5003. Tower 262.         Abrégé de la Police accompagné de Réflexions sur l Accroissement des Villes

      2. Willebrand entstammte einer in Rostock ansässigen mecklenburgischen Kaufmannsfamilie. Er studierte Rechtswissenschaften an der Universität Halle und wurde 1742 zum Dr. jur. promoviert. Nach ausgedehnten Reisen durch Europa wurde er Advokat in Lübeck und heiratete dort. In Lübeck begann er, sich mit der Geschichte der Hanse zu befassen und kann daher als einer der ganz frühen Hansehistoriker angesehen werden. Aufgrund seiner zu dem dänischen Staatsminister Johann Hartwig Ernst von Bernstorff gesuchten Beziehung wurde er 1755 vom Dänischen König zum Justizrat und Mitglied des Pinnebergischen und Altonaer Oberappellationsgericht sowie des Oberkonsistoriums in Glückstadt ernannt. Dies verpflichtete ihn Wohnsitz in Altona zu nehmen. Als Polizeidirektor von Altona (1757-1767) erbat er sich seinen Abschied aufgrund von Reibungen mit Rat und Bürgerschaft der Stadt. Er wurde nunmehr hauptberuflich Schriftsteller im benachbarten Hamburg. 1775/76 erschien sein Hauptwerk Grundriß einer schönen Stadt, in der er Grundsätze einer zweckmäßigen Stadtanlage und Stadtverwaltung entwickelte. Von den übrigen Arbeiten Willebrands ist zunächst der im J. 1765 verfaßte Abregé de la Police zu nennen, ein Handbuch der Polizeiwissenschaft, welches ihm unter anderen Beifallsbezeugungen auch die Anerkennung der Kaiserin Katharina von Rußland eintrug / RR 32310 1 Kupferstich auf Titelblatt Zustand Papier leicht gebräunt, sonst sehr gut erhalten, beinahe neuwertig Ordentl. It "was very popular with collectors and even Linnaeus utilized it to arrange his shells."-Dance, Shell Collecting. An Illustrated History, pp. 58-59. There is an extensive list of shells, with remarks on rarity and desirability, followed by a discussion of private natural history collections in Paris and Holland, with remarks on the outstanding features of each collections. "A storehouse of information on stones and shells. Angolo super. est. bianco di tutte le pagg. un po' iscurito per l'umidità , ma lontano dal testo: la carta è tuttora ben consistente. Ottima copia. Il Boschetto si trova a Nemi in cima a un piccolo colle , è in tutto opera dell'uomo e consiste in un sapiente congegno arboreo mirato a catturare il maggior numero possibile di uccelli. Fra i rami si trovano trappole, ami e reti di ogni genere. "Così misto è il finto e il vero che par tutto naturale ..". " Sì son presi in questi intrichi/Coderosse e Pettirossi/E Fringuelli e Beccafichi/Capineri e Capigrossi/ma i più sono Tordi e Merli/Ch'è uno stupor proprio a vederli". Quando il Marchese e gli ospiti hanno catturato uccelli in quantità  li consegnano alla servitù per la cena, infatti nel giardino c'é "fabbricato uno stanzino sol per cocervi la preda". Moderate toning to text, somewhat heavier in places, light foxing, faint stains to fore-edges of Charter, some staining and edgwear to blank leaves at rear of text. In all a very good, fresh copy in the original state. * This legislative compilation from 1692 to 1743 provides unparalleled insights into the colony's attitude towards Indians, "Free Negroes," piracy, buggery, bestiality, incest, "Jesuits and Popish priests," the killing of bastard children by their mothers, "misspending money in taverns," "keeping the Lord's day," adultery, polygamy and many other social and political topics. Although they are separate works, the Charter and Laws are almost always bound together. And like other copies, this one has additional acts published after 1742. Papers published by the leading French scientific society between 1699 and 1720 on a wide range of topics including geology, meteorology, astronomy, physics, chemistry, scientific instruments, natural history, anatomy, invertebrates, zoology, geography, technical problems, etc. The Swan family was widespread in Ireland with several contemporary or near contemporary persons named Joseph. One possibility is a Joseph Swan (d.1799) who married Anne, daughter of another of Joseph Swan (c.1730-1798), of Tombrean, Co. Wicklow, and who lived at Buckstown, Co. Wicklow.

In 1715 when his father was murdered in London the family returned to Galway. He was educated at T.C.D. and in Paris and settled in Dublin as a medical practitioner in 1736. As an obstetrician, he acquired a huge practice and was master of Dublin's Lying-in hospital 1759-66. He developed the pleasure gardens there and commissioned the building of the Round Room (later the Rotunda) "as a fashionable place of entertainment to provide funds for the hospital ... During his mastership the welfare of patients was improved" and the number of beds increased. As Dublin's leading obstetrician he attended births of both the destitute and the distinguished including the future Duke of Wellington. In 1760 he was knighted for services to the medical profession. His Treatise of Midwifry, on the title page of which he describes himself as a 'Man-Midwife', was one of the earliest obstetric works in the English language and "the most influential work of its time and helped to lay the foundations for Dublin's fame in the history of obstetrics". It is especially noteworthy for Ould's accurate description of the mechanism of natural labour. He advocated the use of opiates in prolonged labour and though he did on occasion use intervention such as forceps he "was a strong supporter of the principle that meddlesome midwifry is bad" [Dictionary of Irish Biography]. The Treatise "was long considered to be one of the best works of its kind - if not the best - in the English language. In it is pointed out for the first time the true position and relations of the child during natural labour" [C. A. Cameron History of the Royal College of Surgeons in Ireland, p.32-3]. Contemp. red morocco, spine and covers richly gilt, front cover bearing giltstamped monogramme "EA". First edition, printed in octavo print space on large quarto paper. "Very rare. Contains the results of the Duke's research into the aims of Freemasonry" (cf. Wolfstieg). "Rare work, privately printed and distributed only among the friends of the Duke in a few presentation copies. Many pains were taken as to typography and decoration, and the book is adorned by several attractive woodcut ornaments" (cf. Seebaß). The title page, engraved by the Ducal medallist to the court Stockmar (cf. Thieme/B. XXXII, 80), depicts a view of the Belvedere Castle near Weimar. - Somewhat browned throughout, but showing very little staining. Endpapers have stamp and copious notes by various hands (some from the 18th century). Engr. armorial bookplate for the Amsterdam collector Francois Gérard Waller (1867-1934) on front pastedown; a work of the English artist Charles William Sherborn (1831-1912). Rosenthal 274. Cette carte par Le Rouge est une version réduite de la cèlèbre carte en 20 feuilles de Henry Popple. La carte de Popple fut la première carte à grande échelle de l'Amérique du Nord et la première également à nommer les treize colonies. Elle fut commandée par les Lord Commissioners of Trade and Plantations ("Représentants de la Couronne pour le Commerce et les Plantations") dans le but de régler les litiges entre les colons anglais, français et espagnols, à propos notamment de la région du Mississippi et ses affluents.       1742. Folio (235 x 380 mm). 28 engraved plates (3 unnumbered and 25 numbered consecutively), in magnificent contemporary colour throughout, raised in gilt. Contemporary brown calf; spine rebacked with giltstamped red label; leading edges gilt. Marbled endpapers. All edges red. Exceedingly rare, brilliantly hand-coloured set of costume engravings by the Augsburg master Martin Engelbrecht, depicting the protagonists of the War of the Austrian Succession then raging in Silesia. Some 150 plates we published in this series which cashed in on the timely subject and, specifically, the warriors' exotic appeal. They usually appear separately and were frequently cut out (one of the most popular applications of Engelbrecht's output); OCLC lists a single copy bound as a book with the title. - The combattants who aroused the greatest sensation were the fierce soldiers from the Habsburg monarchy's military border, first and foremost the Slavonian Pandours, notorious for their savagery. Ten engravings are dedicated to these vicious braves, including a portrait of their famous commander, Baron Francis Trenck, while nine more show Hungarian foot soldiers ("Tolpatches"), some on horseback. There is an unspecified Croat as well as a Dalmatian "Morlach"; a portrait of commander Johann Daniel von Menzel, like Trenck a master of the guerilla style; another of the towering Irishman James Kirkland, one of the "Potsdam Giants"; as well as a Prussian Hussar and a Lancer. The first two plates show the rulers Maria Theresia of Austria and Prussian King Frederick II who fought for sovereignty over Silesia. Each plate is accompanied by caption, usually a four-line rhyme pointing out the characteristics of the man depicted. Vividly coloured throughout in a contemporary hand with touches of gold heightening. Some slight thumbstaining, but very well preserved altogether in its first binding, its spine professionally restored. OCLC 731447059 (Zurich).
