Mudd, Edward Spangler, and Samuel Arnold, Charged with Conspiracy and the Murder of Abraham Lincoln, Late President of the United States. Delivered June 27 and 28, 1865, before the Military Commission, Washington, D.C.” Government Printing Office: Washington, 1865. Soft Cover, 122pp, 5.75” x 8.75”. Front and back covers are loose and chipped at edges with one mid-horizontal tear at the right edge of the front cover. Owner’s name “Edw Elderkin” penned in upper right of front cover. Back cover irregularly toned. Other than tear and partial fraying at the left margin of the title page (same text as on the cover), the book, bound with string, is internally sound with light soiling on rear pages. On May 1, 1865, President Andrew Johnson ordered a trial be held for “the persons implicated in the murder of the late President…” Appointed by Pres. Lincoln in 1864 as Judge Advocate of the Union Army with the rank of Major, John A. Bingham was named the trial’s Special Judge Advocate. The book here offered is Judge Bingham’s reply to the arguments of each of the accused conspirators’ counsel. On June 30, 1865, the Military Commission decreed that all accused were guilty. Surratt, Herold, Payne, and Atzerodt were sentenced to die, O’Laughlin, Mudd, and Arnold to life terms, and Spangler to a prison term of six years.
