Coke, Edward, Sir (1552-1634); Swinton, John (1703-1777); Baker, George
Quinta pars relationum Edwardi Coke Equitis aurati, Regij Attornati Generalis / The fift part of the reports of Sr. Edward Coke Knight, the Kings Attorney Generall. [STC 5504]
London: London printed for the Companie of Stationers. Anno Dom. 1605., 1605. Hardcover. Very Good. Modern quarter-leather over buckram, endpapers renewed. Ex-library, with small stamps on the verso of the title-page and on folio 39v. Lacks the tract "De iure Regis ecclesiastico," inserted between A8 and [2]B1 in most copies. Laid in is a draft manuscript report of a motion for arrest of judgment in R. v. Baker, K.B. Trin. 13&14 G.2 (1740), which was an information for a libel by George Baker on the Rev. John Swinton. The report is on a single side of a half sheet, 250 x 185 mm; based on the obliterations and interlineations, it seems to be a draft. For background on the case, see A Faithful narrative of the proceedings in a late affair between the Rev. Mr. John Swinton, and Mr. George Baker (1739) (ESTC T35232) (HOLLIS No. 004093710), reprinted in Secret Sexualities 85-100 (Ian McCormick, ed., 1996); Lee Edelman, Homographesis: Essays in Gay Literary and Cultural Theory 123-124 (1994); E. I. Carlyle, 'Swinton, John (1703-1777)', rev. Rictor Norton, Oxford Dictionary of National Biography, Oxford University Press, 2004 (stating that Baker successfully sued Swinton for defamation).
