A Legal Review of the Case of Dred Scott, as decided by the Supreme Court of the United States. From the Law Reporter for June, 1857

Boston: Crosby, Nichols, and Co., 1857. First separate edition. Stitched paper wrappers. A very good+ copy, wrappers mildly worn, mainly along the spine. 8vo. Eleven years earlier, Dred Scott sued for his freedom in one of the most famous of all Supreme Court cases, one he lost and which ultimately led to the Civil War. "One of the earliest and best argued legalistic attacks on Chief Justice Taney's opinion in Dred Scott. It first appeared as an article in the June 1857 issue of the Law Reporter, which at that time was edited by Lowell.... Both authors were bright young men in the legal profession. Lowell ultimately became a federal district judge and Gray would spend twenty-one years as an associate Justice of the U.S. Supreme Court. Although Gray and Lowell are quite mild in their criticism of Taney, the pamphlet is an excellent example of how conservative Northern lawyers were appalled by the partisan and unjudicial [sic] nature of Taney's opinion. They suggest that his opinion ?is unworthy of the reputation of that great magistrate (p.9). In dissecting Taney's opinion, they present several arguments: (1) They argue that Negroes could be citizens of the U.S. This is primarily a historical argument taken mostly from Justice Curtis? dissent. (2) If Taney is correct in his assertion that the Supreme Court has no jurisdiction in the case, because a black man cannot sue in federal court, then he also has no right to examine the merits of the case. (3) Congress has the right to regulate the territories. (4) The Somerset rule is good law in the United States and thus any slave brought into a free jurisdiction by his master becomes free the moment that slaves touches free soil. (5) The U.S. Supreme court does not have to follow the rule on Dred Scott?s status as decided by the Missouri Supreme Court...? Paul Finkelman (Slavery in the Courtroom: an Annotated Bibliography of American Cases, pp. 51-52). ABPC shows only one at auction in the last quarter century. Sabin 78260. LCP Afro-Americana, 4232.         Wild Adventures in Australia and New South Wales, Beyond the Boundaries, With Sketches of Life at the Mining Districts

London: James Blackwood, 1857. Small octavo, tinted lithograph frontispiece and one other plate; bound in later calf and marbled boards, bookplate of James Edge Partington. Firsthand account of the gold rush. An eventful narrative of adventures in Australia with rich descriptions of Aboriginal life in north Queensland, including a glossary of native words and phrases.By his own account Frederic Cooper was a roustabout in who travelled Australia in search of work. His account begins with a description of a gale and subsequent wreck on the Great Barrier Reef. After reaching the shore in a long boat, Cooper worked variously as a cedar cutter and stockman in the north before travelling south seeking quick fortune on the Victorian goldfields, described in two fulsome chapters.Cooper recounts conflicts with Aboriginal tribes around Maryborough and the Burnett River region, stressing the warriors he met 'are not the spiritless, crushed beings that may be supposed from the descriptions that have hitherto been drawn of the natives.' Although often engaged in armed confrontations, Cooper nonetheless records many aspects of Aboriginal life, including cooking, camp organisation and ceremonies. Significantly, a rudimentary glossary of the "Neungir" dialect is provided in an appendix of eight pages (Cooper describes Neungir as the lingua franca of the tribes dwelling between Moreton Bay, the Gwyder River and Port Essington).

James A Garfield?s signed copy of ?Elements of Geometry and Comic Sections? used by him while teaching college mathematics

"The first Presidential memorial library, completed at the Lawnfield estate in Ohio by the widow of James Garfield four years after his assassination, houses almost 3,000 books that were used and treasured by the 20th president. Books were a scarce commodity to young James, who lost his father before the age of two, and was raised by his mother who struggled to maintain a humble existence. Both James Garfield and his wife Lucretia were voracious readers and amassed a large collection of books. Some twenty years ago, several dozen of his books were de-accessioned, and one of these books is described below:Book signed ?J.A. Garfield / Hiram 1857? in pencil on first blank flyleaf. ?Elements of Geometry and Conic Sections? by Elias Loomis, New York: Harper & Brothers, 1857. 226 pages, 5? x 7.5?. Waterstained and foxed pages, text completely legible. Cloth covers, repaired hinges, damaged spine, most of black label present with gilt lettering ?Loomis? / Geometry?. Slight separation of last section of pages from spine. Blank portion torn away at lower edge of first blank flyleaf. Garfield?s 2.5? x 1.5? bookplate ?Inter Folia Fructus / Library of / James A. Garfield? affixed inside front cover. Fine condition. Placed in a custom-made dark brown cloth covered four-flap box housed in a matching custom-made dark brown cloth covered slipcase with black label on spine, gilt-lettered ?Elements of / Geometry / Elias Loomis.? Gilt-lettered on lower portion of slipcase spine ?James Garfield?s / Signed Copy / 1857?.In 1851, after finishing his studies in at Geauga Seminary in Chester, Ohio, James A. Garfield entered the principal educational institution of the Campbellites, Hiram Eclectic Institute (later Western Reserve Eclectic, then Hiram College). He made his expenses by teaching in the English departments, and also gave instruction in the Latin and Greek. After three years, in the autumn of 1854, James A. Garfield entered the junior class at Williams College in Massachusetts and graduated with the highest honors in the Class of 1856; he was leaving for his 25th Class Reunion in 1881 when he was assassinated. After graduation, Garfield returned to teaching at Hiram. A year later, Garfield became president of Western Reserve Eclectic, serving from 1857-1861. After it attained collegiate rank in 1867, the school changed its name to Hiram College. While serving as president, Garfield taught Latin, Greek, higher mathematics, history, philosophy, English literature, and English rhetoric."

I could be mistaken in asserting this as first edition, it shows no later printings and I surmise was not reprinted in this era. It is X-library, showing marks from the time of it's making thru 1951 of this staus. Ribbed at spine with title done in gilt on red, balance tan leather. Ribs and boards edges have gilt work. First pastedown has seller and xlibrils labels. Text edges have Law Library stamps. 328 pages w/ a good bit of text darkening, binding holding beautifully.       New York City: J. S. Redfield. Bound in original brown cloth with gilt spine lettering. 1857. 1st edition. hb. Small 8vo, pp. 401, ads. Bds. heavily worn & bumped, with noticeable soiling. Rear hinge cracked, binding a bit sprung, ffep removed; still a good copy. . Martha Griffith Browne (also known as Mattie Griffith) was a white woman who, prior to her conversion to abolitionism, had owned slaves. She wrote sketches and poems for "The National Anti-Slavery Standard", before writing this fictionalized slave narrative in 1856. "Autobiography of a Female Slave" is one of several noteworthy antebellum novels about slavery that were written by abolitionist authors. In some cases these novels reflected the storytelling style and conventions of the slave narrative so convincingly that they were mistaken for actual autobiographies of former slaves. The effectiveness of these novels in representing slavery, and the point of view of slaves, made them useful weapons in the antislavery struggle. (See: "Documenting the American South. North American Slave Narratives", University of North Carolina [Chapel Hill] - available online; also "Black Slave Narratives", John F. Bayliss (ed.) Macmillan, 1970). The title has recently been reprinted a number of times. Although the copyright page shows the date of 1856, when the novel was written, it was not published until 1857. This is the first edition, and a very scarce title, in its original, unsophisticated, binding. .

        Australian Album 1857

Sydney: J.R. Clarke, 1857. Large quarto, with a total of ten lithographic plates, including the illustrated title-page and frontispiece; comprising eight musical scores with introductory letterpress (preface and contents leaves); a very good copy in original red cloth decorated in gilt and lettered "Australian Album" to the front board, some wear to the upper joint and extremities, as to be expected of a book of this nature. The first Sydney songbook. First edition of the first music album published in New South Wales, publishing eight Australian musical scores for a popular audience.Although individual songs and sheet music scores had been printed previously, this is the first complete published musical album. A such, it includes a title-page and frontispiece (in addition to illustrated title-pages for each song), a welcoming preface and table of contents. Furthermore, Clarke had the album published in decorative gilt titled red cloth, clearly showing this book was intended as a cherished possession - in contrast to the relatively ephemeral nature of sheet music production. Although Isaac Nathan's 1849 publication The Southern Euphrosyne does indeed feature musical content, it is interspersed with anecdote, reminiscences and other detail, and cannot be regarded as a musical album as such. The preface to the Australian Album, penned by budding author Frank Fowler, is of some interest. It proudly boasts the compositions are all Australian, indeed 'are all new - all colonial. Here - in this city - they were played, printed and published... We can send the work home as a specimen of what we can do out here at Botany Bay - as an index of our education, refinement, art-feeling'. The reference to the thriving port of Sydney as 'Botany Bay' is an ironic reference to the convict past, and reflects a strong emerging national identity. Publications such as the Australian Album are typical of the era immediately following the end of convict transportation to the east coast of Australia, when an emerging middle class of free settlers strove to define a new identity for the colony. The Australian Album is valued for the splendid title-pages accompanying each of the songs. They are the work of Edmund Thomas (1827-1867) who had earlier illustrated a well-received album of Melbourne views. A testament to the skill of lithographic printing in Sydney by the mid-nineteenth century, the ten plates include scenic views of the Botanic Gardens, Sydney Heads, Rose Bay, the North Shore and Rose Bay. These images capture Sydney leisure activities, with prosperous citizens enjoying the natural beauty of the harbour and environs.Clarke was quick to capitalise on the fame of visiting celebrity performers, and the album contains two portrait plates. The first depicts Irish singer Catherine Hayes who toured Australia throughout 1855-1856, and also second is Austrian violinist Miska Hauser. The Australian Album is scarce indeed; we have been able to locate only two copies held in public collections (at the University of Queensland and also in the Fisher Rare Book Library of Sydney University). It is conspicuously absent from the catalogue of the exhibition 'Music Printing and Publishing in Australia' held at Monash University in November 2000.
