THE FOLLOWING ARE THE AMENDMENTS TO THE NEW CONSTITUTION, PROPOSED BY THE HON. MR. MADDISON [sic]. [Contained in:] GAZETTE OF THE UNITED STATES. No. XVIII

New York, 1789. Three small stab-holes in the margin. Lightly toned, stained around the edges. Some small paper repairs at edges. Very good. The second printed appearance of the first draft of the Bill of Rights. What became the first ten amendments to the United States Constitution were first proposed by James Madison in the House of Representatives, then sitting in New York, on June 8, 1789. Madison's proposals were first printed in the New York DAILY ADVERTISER on June 12, followed the next day by this June 13 issue of the GAZETTE OF THE UNITED STATES - more than three months before they were finalized and approved by the Congress and sent to the states for ratification. James Madison's proposals appear on the third page of this issue, as part of a section giving a "Sketch of Proceedings of Congress," which summarizes activities that took place on June 10, 11, and 12. The resolution as introduced by Madison reads: "Resolved, That the following amendments ought to be proposed by Congress, to the legislatures of the States, to become, if ratified by three fourths thereof, part of the Constitution of the United States." Madison's recommendations are listed as nine proposals, several of which contain multiple clauses. The first proposal proclaims that "all power is originally vested in, and consequently derived from the people," that government is instituted for the benefit of the people, and that they have an unalienable right to reform or change their government. Proposal Four contains much of what became the Bill of Rights: guarantees of religious freedom, freedom of speech and of the press, freedom to assemble, and the right to keep and bear arms. Also, defenses against unreasonable search and seizure, the right to confront witnesses against the accused at trial, protections against self-incrimination, safeguards against double jeopardy, and the right to a speedy and public trial. Madison's proposals were eventually expanded to seventeen Amendments passed by the House of Representatives, which were then winnowed down to twelve by the Senate, of which ten were ratified by the states. Madison's language here is often identical to that of the Bill of Rights as finally approved. The GAZETTE OF THE UNITED STATES was the only newspaper of record during the early years of the Federal government, and was the primary means of disseminating the proceedings and debates in the First Congress at a time when the government of the United States was busy defining itself in terms of the new Constitution. By any account the GAZETTE is the most reliable primary source for United States government affairs and political issues during the critical first Federal Congress of 1789-91. One of the dominant issues of the first year of the government, carrying over from the previous year's debate over ratification of the Constitution, was the need to augment the Constitution to protect individual rights and liberties. That issue was directly addressed in the development of the Bill of Rights. John Fenno established the GAZETTE OF THE UNITED STATES in New York as a Federalist organ to support the new government. The first issue appeared less than two months before the present issue, on April 15, 1789, announcing itself as a semi-official medium for the proceedings and debates of Congress, and promising to print "essays upon the great subjects of Government in general, and the Federal Legislature in particular; also upon the national and local Rights of the American Citizens, as founded upon the Federal or State Constitutions...." Fenno was paid by the government for printing the proceedings of Congress, and the leading Federalists (including Hamilton) stepped in with additional financial assistance when necessary. When the seat of government moved to Philadelphia, Hamilton and others aided Fenno in transferring the newspaper there. This is essentially the earliest version of any form of the Bill of Rights obtainable. Issues of the New York DAILY ADVERTISER from this period are exceedingly rare. A landmark printing of Madison's initial proposal of the Bill of Rights, the fundamental defense of American rights and liberties. A copy brought $31,200 at Swann Galleries in April 2012.

The History of the Rise, Progress, and Establishment, of the Independence of the United States of America:

London: Printed for the Author,, 1789. including an Account of the Late War; and of the Thirteen Colonies, from their Origin to that Period. 3 volumes, octavo. Contemporary lightly sprinkled sheep, red morocco labels. Folding map frontispiece to volumes I and II. A little rubbed, and with some judicious restoration to the spines, joints, and corners, typical browning throughout, but overall a very good set on an elusive work. First American edition, published the year after the London edition. "First full-scale history of this war by an American" (Howes). Born in Hertfordshire in 1727/8, Gordon was educated for the dissenting ministry and ordained in 1754. In 1770 "his political sympathies prompted him to move to America, where he lived for about fifteen years. In 1772 he was pastor of the Third Congregational Church at Roxbury, Massachusetts. In the same year he was made chaplain to the provincial congress of Massachusetts. In early 1776 he was dismissed from both houses after delivering a harsh attack on article 5 of the articles of confederation" (ODNB) He returned to London in 1786. Gordon had decided to write a history of the events he witnessed in North America, and in 1776 he "began collecting correspondence and interviewing military officers and statesmen. He believed that the new republic would not be receptive to an impartial history and so hoped to have better success in England. His History of the Rise, Progress, and Establishment of the Independence of the United States of America first appeared in London in 1788 and in an American edition the following year. It remained a primary authority on the conflict for the next century. Gordon received £300 for his efforts." Sabin considers that "Gordon is deservedly reckoned as one of the the most reliable and impartial of the numerous historians of the American Revolution."

JOURNALS OF THE GENERAL CONVENTION, WITH SERMONS [volume half title]

Philadelphia, and dates, as described below]. Bound to style in antique three-quarter calf and marbled boards, spine gilt, leather label. Foxing. Some minor soiling. Contemporary manuscript annotations and inscriptions throughout. Very good. The first three journals of convention for the Protestant Episcopalian Church, with three significant early sermons. The Episcopal Church was a derivative of the Anglican Church, which fell out of favor during the American Revolution. Many members of the Anglican Church were Loyalists who fled during and after the Revolution, and the deep-seated American suspicion of an established church, one of the contributing elements to the American Revolution, making it untenable for the Anglican churches in the United States to continue as before. The American Anglicans who remained reconstituted themselves into the Protestant Episcopal Church in the United Sates of America. The Episcopal Church in America formally separated from the Church of England in 1789, with a revised Book of Common Prayer and a clergy who was not under the supremacy of the British monarchy; but for all practical purposes the formal division took place during the war, and was formalized in the documents bound in this volume. These JOURNALS detail the early groundwork laid for the formal establishment of the Episcopal Church. William White, the author of the third sermon in the collection, became the first bishop of the American church. All the pamphlets were issued separately, but appear to have been bound together with a common half title. The titles are as follows: 1) JOURNAL OF A CONVENTION OF THE PROTESTANT EPISCOPAL CHURCH IN THE STATES OF NEW-YORK, NEW-JERSEY, PENNSYLVANIA, DELAWARE, MARYLAND, VIRGINIA, AND SOUTH- CAROLINA; HELD IN CHRIST-CHURCH, IN THE CITY OF PHILADELPHIA, FROM SEPTEMBER 27th TO OCTOBER 7th, 1785. [2],18pp. Philadelphia: Printed by Hall and Sellers, 1785. With a half title. EVANS 19209. 2) Smith, William: A SERMON PREACHED IN CHRIST-CHURCH, PHILADELPHIA, ON FRIDAY, OCTOBER 7th, 1785, BEFORE THE GENERAL CONVENTION OF THE PROTESTANT EPISCOPAL CHURCH...ON OCCASION OF THE FIRST INTRODUCTION OF THE LITURGY AND PUBLIC SERVICE OF THE SAID CHURCH, AS ALTERED AND RECOMMENDED TO FUTURE USE, BY THE CONVENTION. Philadelphia: Printed and sold by Robert Aitken, 1785. 40pp. EVANS 19247. 3) Wharton, Charles H.: A SERMON ON THE RELATIONS OF THE CHRISTIAN MINISTRY. PREACHED AT ST. PETER'S AND CHRIST CHURCH, IN THE CITY OF PHILADELPHIA, THE SECOND DAY OF OCTOBER, 1785, AND PUBLISHED AT THE REQUEST OF THE EPISCOPAL CONVENTION. Philadelphia: Printed and sold by Robert Aitken, 1785. 24pp. EVANS 19383. 4) JOURNAL OF A CONVENTION OF THE PROTESTANT EPISCOPAL CHURCH IN THE STATES OF NEW-YORK, NEW-JERSEY, PENNSYLVANIA, DELAWARE, MARYLAND, VIRGINIA, AND SOUTH- CAROLINA, HELD IN THE CITY OF PHILADELPHIA, FROM JUNE 20th TO THE 26th, 1786. Philadelphia: Printed by Hall and Sellers, 1786. [2],18pp. With a half title. EVANS 19941. 5) White, William: A SERMON, DELIVERED IN CHRIST-CHURCH, ON THE 21st DAY OF JUNE, 1786, AT THE OPENING OF THE CONVENTION OF THE PROTESTANT EPISCOPAL CHURCH.... Philadelphia: Printed by Hall and Sellers, 1786. [2],31pp. EVANS 20145. 6) JOURNAL OF A CONVENTION OF THE PROTESTANT EPISCOPAL CHURCH IN THE STATES OF NEW-YORK, NEW-JERSEY, PENNSYLVANIA, DELAWARE, AND SOUTH-CAROLINA, HELD AT WILMINGTON, IN THE STATE OF DELAWARE, OCTOBER 10th AND 11th, 1786. Philadelphia: Printed by Joseph Crukshank, 1786. 22pp. EVANS 19942. This volume is also heavily inscribed and annotated by Samuel Ogden. Ogden was a prominent Episcopalian and an ardent patriot in the Revolution, during which he served as a colonel in the New Jersey militia. He was a good businessman and had a nail factory and a grist mill, as well as a large land holding in New York State. Ogden's father, Uzall Ogden, was a delegate to the convention from New Jersey. The first few blank leaves contain plans for a farmyard and what may be Ogden's grist mill. An important piece of American history with a nice association.

A System of the Law of Marine Insurances: With Three Chapters on Bottomry; on Insurances of Lives; and on Insurances against Fire

Philadelphia, (PA): Joseph Crukshank, 1789. First American edition. 8vo. xvi, (8) xliv, 530, (45) pp. Francis Hopkinson's copy, with his ownership signature at the head of the title page and his armorial bookplate on the front pastedown; Hopkinson (1737-1791), lawyer, judge, merchant, author, musician, and Signer of the Declaration of Independence, was born in Philadelphia and was the first to earn a diploma at the College of Philadelphia, in 1757. After reading law and spending a year in England, he published a good bit of music and poetry in the 1760s; by late 1773 he had moved to Bordentown, New Jersey, where he took up the law again and rose rapidly, being elected to the Continental Congress in 1776 and signing the Declaration of Independence with other members in July. During the war he held important administrative offices and saw his house in Bordentown plundered by the British. "Though he was not preeminent in any one field the bulk of his attainments is sufficient to make his place in American history secure" (DAB). First published in London, 1787, Park's was the first legal work on insurance written by an English lawyer and the first book on the subject to appear in America. Holdsworth called it "the best text-book upon the law of insurance." A work of great authority, it went through numerous English and American editions and remained the standard text until the middle of the nineteenth century. Evans 22048. Holdsworth "History of English Law" XII, 390. Cohen "Bibliography of Early American Law" 7071. Hinges a little cracked, joints just starting to crack at ends, but a sound copy with an appealing association, the copy of a Signer of the Declaration of Independence who spent some ten years as a judge on various American admiralty courts. Contemporary calf, (rubbed, a little chipping at head of spine, corners bumped), gilt rules and leather label on spine. (#6450)

With additional title page for "Estampes destinées à orner les editions de M. de Voltaire." Front pastedown with heraldic bookplate of "C D." Bengesco 403; Furstenberg 111; Cohen-de Ricci 1028; Ray 52. Slight bumping to corners, extremities a little rubbed, occasional faint foxing to the (vast) margins, otherwise a fine copy, clean and fresh internally, with rich impressions of the plates, and in a lustrous, scarcely worn binding. This very handsomely bound volume is a special Large Paper version from the Kehl edition of Voltaire's "Works," which up to the time of its appearance was the most extensive and most expensive publishing venture ever undertaken in a short space of time. With type purchased from John Baskerville, England's greatest printer of the period, the edition was originally planned as a full-fledged grand-quarto work, but this idea was quickly abandoned in favor of the more affordable octavo. As a result, "The Henriade" was the only work with any copies produced in the larger size. According to Ray, "when Beaumarchais changed the format of his edition from quarto to octavo, Moreau redesigned his already completed engravings for "La Henriade" and other works to fit the new format. In our special Large Paper copy, we see the wonderful illustrations in their original form. Jean-Michel Moreau, known as Moreau le Jeune (1741-1814), provided illustrations for Diderot's encyclopedia and engraved works for François Boucher, in addition to illustrating the works of Rousseau and Voltaire. According to the Getty Museum, "publishers sought him out for his powers of observation and ability to capture nuances of gesture, pose, and light." Ray says that the best work by Moreau "showed him to be the equal of the established rococo masters Boucher, Eisen, and Gravelot," and that in his heyday, "he carried all before him." First published (under the title "La Ligue") in 1723, the epic "La Henriade" is divided into 10 cantos that deal with the siege of Paris by Henri III and Henri of Navarre (later Henri IV), and it opens with an imaginary account of the latter's mission to Queen Elizabeth. The historical piece also serves as an indirect condemnation of civil unrest and religious fanaticism. Our lovely binding--elegant, stately, and at the same time with considerable animation--is the work of Pierre-Jean Bradel (called "Bradel le Jeune"), a nephew of Derôme le Jeune and younger brother to Alexis-Pierre Bradel, binder for the Bibliothéque Nationale at the end of the 18th century. According to Flety, the younger Bradel had a workshop at 1 rue d'Écosse (the address on the ticket here) from 1799 to 1804. The Neoclassical design elements seen in our French binding (for example, broad and complex gilt-decorated frames, scalloped panels, double bands flanking morocco inlays) reflect an international style popularized by Staggemeier & Welcher in London, F. W. Standlander in Stockholm, and Georg Friedrich Krauss in Vienna. The present volume stands out from the vast majority of Bradel bindings, which are relatively plain; it employs the same urn tool and similar design elements as #153 in the Schiff Collection, but it is far more elaborate in both tooling and inlays.

WIEN: VUE GENERALE DE LA VILLE DE VIENNE.

Contemporary black half calf, gilt ornamented spines with gilt lettering, marbled sides, spine of the atlas volume bound to match at a later date. An attractive and complete set of the entomology section of the famous 'Encyclopédie Méthodique'. The 'Discours préliminaire.' in the first volume is by P.J. Mauduyt. The remaining of the first volume and volumes 2-5 are by the well-known entomologist G.A. Olivier, volume 6 is by P.A. Latreille and J.B. Godart, the final text volume is by Latreille, Le Peletier de Saint-Fargeau, Serville and Guérin, the text belonging to the atlas volume is by Latreille. The 'Encyclopédie Méthodique' is one of the major scientific publication achievements of all time. A complete set of the entomology section with contributions by the most famous entomologists of the time is rare as it was published during the French revolution and spans almost the complete period of publication (1782-1832) of the encyclopedia. "The 'Encyclopédie méthodique.' was one of the largest projects ever conducted to bring together in one publication all the knowledge that existed at one particular time in history. For natural history, this work takes on a special significance because the publication of the EM would be the first time since Linnaeus' 'Systema Naturae' that a complete synthesis of all that was known taxonomically about plants and animals would be printed. At that time, Paris was considered by some as the center of scientific knowledge and a Mecca for scientists. This was chiefly because the major museum of natural history, the Jardin du Roi (and precursor to the Muséum Nationale d'Histoire Naturelle), contained the vast collections of plants and animals made by the many French voyages of exploration that took place in the 1700s" (Evenhuis. Dating and publication of the Encyclopédie Méthodique p. 2).Provenance: Label with name of Kikumaro Okano on inside front-cover.Nissen ZBI, 4621. [Attributes: Hard Cover]

EXTRAIT DES REGISTRES DE L'ASSEMBLÉE PROVINCIALE DE LA PARTIE DU NORD DE LA COLONIE FRANÇOISE DE SAINT-DOMINGUE. DES DELIBÉRATIONS DE LA SÉANCE DU MERCREDI 18 NOVEMBRE 1789...[caption title]

[Cap-Français, 1789. Old folds, minor wear at edges, some minor foxing. Very good. Broadside, signed in type by Jean-Jacques Bacon de la Chevalerie (1731-1815) as President and by Geanty as Secretary, concerning the local militia. This broadside is an excellent testimony to the formation, in August 1789, of assemblies composed of white settlers only - which was actually illegal until their authorization by the National Assembly in a decree of March 8, 1790, made under the pressure from the colonial committee in Paris which realized the situation on St. Domingue was out of control. Here, the assembly deals with the organization of a militia responsible for ensuring the public tranquility, on the model of the National Guard in the Paris. Brigadier Bacon de la Chevalerie, chosen from the outset by the settlers to chair the Northern Provincial Assembly, declared himself leader of the white separatist movement on the island and played a significant role in the revolutionary events of the period. A rare format for surviving imprints from St. Domingue. From imprints handled by this firm we know that there was a rich print culture in St. Domingue on the verge of the revolution. There were presses at Saint Marc, Port-au- Prince, and Cap Français, with probably two or three different printers at each of the last two. All Caribbean printing is quite rare. Absent the BN of France. Full Veu contemporary. Smooth back to the net. Parts of title and volume number of red and black. Fillets border on covers. Gilt edges. Some frictions. Antoine de La Salle (1754-1829), philosopher and scientist, was certainly one of the most interesting thinkers of his time, his ideas, sometimes whimsical and messy made him the leader of the physico-moral school. The share of physiognomy naturally has an important role in this theory. The Mechanics is both a classic treatise of physiognomy, and another to consider the relationship between the moral and body way from an educational perspective. Besides this, the Mechanics is also a treaty of understanding and logic, there are theories about the phonetics and linguistics, in short everything related to human, moral, intellectual and physical. The room had an eventful life, made many trips, visited America and Asia, studied the relationship between Buddhism and Christianity, wrote an unpublished history of China, and learned Arabic. Then, having left the Navy, he surveyed Europe, living in Spain and Italy before returning to settle in Paris where he devoted himself to philosophy and science. --- Please note that the translation in english is done automatically, we apologize if the formulas are inaccurate.

(Buijnsters) De reis liep van Velsen, Santpoort, Spaarndam, Halfweg, Amsterdam, Zaandam, Amstelveen, Ouderkerk, Naarden, Muiden, Weesp, Haarlem, Heemstede, Bloemendaal, Leiden, Voorhout, Sassenheim, Warmond, Leidsendam, Oegstgeest, Rijnsburg, Noordwijk, Katwijk, Wassenaar, Den Haag, Scheveningen, Rijswijk, Voorburg, Delft, Loosduinen, Monster, 's Gravesande, Naaldwijk, Wateringen, Maassluis, Schiedam, Vlaardingen, Rozenburg, Brielle, Hellevoetsluis, Rockanje, Brielle, Goeree, Overflakkee, Sommelsdijk, Dirksland, Middelharnis, Klundert, Dordrecht, Willemstad, Geertruidenberg, Zwijndrecht, Dubbeldam, Sliedrecht, Gorcum, Woudrichem, Asperen, Heukelom, Leerdam, Vianen, Ysselstein, Ameide, Nieuwpoort, Schoonhoven, Oudewater, Woerden, Bodegraven, Gouda, Zwammerdam, Moordrecht, Rotterdam, Alphen, Buiksloot, Broek, Marken, Monnickendam, Edam, Hoorn, Enkhuizen, Medemblik, Alkmaar, Schermerhorn, Beemster, Purmerend. Over tal van plaatsen worden bijzonderheden meegedeeld, voornamelijk betreffende de situatie in ca. 1790, die men in andere beschrijvingen niet vindt.

        The Loiterer

Oxford: Printed for the author and sold by C. S. Rann [others in later parts],, 1789?-90. Octavo (208 x 125 mm) in 60 parts, with printed part-titles for each. Contemporary pale tan polished calf, spine divided in 6 compartments by raised bands, red morocco label, other compartments gilt with central flower tools. Contemporary ownership inscription of R. Ekins at head of front free endpaper. Joints starting, some light chipping and wear, part-title for No. 2 mounted on a stub, Q1 with small marginal tear in corner with loss, marginal worming to a few leaves, a very good copy. First edition, possibly Jane Austen's first appearance in print. This scarce periodical was written by James and Henry Austen while they were at Oxford. Some scholars have suggested that in issue number 9, the letter signed "Sophia Sentiment" was the work of their sister Jane when she was 14. Although Gilson does not include this work in his Bibliography, there is a strong case that the work was written by Jane Austen. According to the British Library, "critics such as Paula Byrne have noted that there are various correspondences between the letter and Jane Austen's juvenilia. Her early, epistolary novel Love and Freindship [sic], for example, has two heroines quite as shallow as Sophia. But other critics, such as Kathryn Sutherland and Claire Tomalin, find it unlikely that Austen would have written a letter so critical of women's reading choices. They suggest that Sophia Sentiment's letter was probably written by one of Austen's brothers." Even if "Sophia Sentiment" cannot be definitively linked with Jane Austen, the experience her brothers had in printing this work no doubt had some influence on her. Gilson suggests that it was through the publication of The Loiterer that she became acquainted with Egerton of Whitehall (who were the London distributors of this work from the fifth number on) who later published her Sense and Sensibility.
