Ex-library with small label affixed to lower corner of front downpaste endpaper. Binding shows wears with bumps and tears in leather at board corners and along hinges and extremes of spine. One of the cords is broken making the top of the front board loose. However, binding remains secure. Pages clean. Text unmarked. This fifth part of the Miscellany Poems is the second volume produced by Jacob Tonson after John Dryden's death. Dryden had edited the first 4 volumes but Tonson, finding continued success with the series, continued the project. Rare true 1709 edition of an extremely popular "Household apothecary", an encyclopaedia of household medicinal recipes, written by Eleonora Maria Rosalia (1647-1704) in Silesia and Moravia, Herzogin of Troppau and Jägerndorf, with an appended cookery book. First published at Vienna in 1695, the Granat-Apffel went through about twenty editions in the next sixty years. Beginning with the 1697 edition (also published in Vienna), it included a cookery book as an appendix, described as compiled by an unnamed "Hoch-adelichen Persohn". While herbal medicine had often been practiced by (lower-class and noble) women over the centuries, the Renaissance increasingly brought them (and male authors of popular medical books as well) into conflict with the academic physicians and botanists who were developing new scientific methods. Noble women had the education, means and the security to publish books of household medicinal recipes. The Granat-Apffel was one of the most successful. Its numerous editions exerted an enormous influence on the art of healing and cooking for nearly two hundred years.With one or a few mostly marginal worm holes running through much of the book, affecting a few words of text only in a few leaves, with occasional slight browning, a small stain or other minor defect and with faint offsetting on a half-dozen leaves, but otherwise in good condition. In 1646 he was named ambassador extraordinary to Holland, and took part in the conferences at Munster. Sent in 1661 to England, he obtained in 1662 the restitution of Dunkirk. In 1667 he negotiated the treaty of Breda with the king of Denmark, and in 1678 the treaty of Nijmwegen, which ended the war with Holland. Independently of these diplomatic missions, he took part in the principal campaigns of Louis XIV, in Italy (1648), in Catalonia (1655), in Holland (1672); and was created marshal of France in 1675. As the clergy cannot afford to buy all books necessary for their studies, Parochial Libraries have been erected all over England. However, these need to be preserved and it must be ensured that no books are stolen etc. This act states the rules for the clergy and/or founders of those libraries to follow. A.o. catalogues have to be made: Where any library is appropiated to the use of the Minister of any Parish or Place, every Rector, Vicar, Minister or Curate of the same, within six months after his institution, induction or admission, shall make or cause to be made a new catalogue of all books remaining in, or belonging to such library and shall sign the said catalogue, thereby acknowledging the custody and possession of the said books, which said catalogue to be signed, shall be delivered to the proper Ordinary within the time aforesaid, to be kept or registered in this Court, without any fee or reward for the same. Also after the death of the owner of a library, the library must be locked to avoid theft etc. etc. An interesting document.

Pr. by Charles Bill, & the Executrix of Thomas Newcomb, 1709. Publication of this treatise on high treason followed hard on the heels of the Treason Act 1708 (7 Ann c 21), by which Parliament "harmonized" the laws of high treason in "Great Britain" following the union in 1707 of England and Scotland, each of which had different and sometimes quite distinct concepts of "high treason." The final part of this small volume bears a title-page reading "A form and method of trial of commoners, in cases of high treason, and misprision of high treason," with the same imprint information at the main title. (A woman tried and convicted, seeking a stay of execution because pregnant, may pray "a Jury of [12] Matrons or Motherly Women" confirm and attest the same; other data are equally particular and evocative.) While the pagination and signature markings of this final part are not continuous from A collection of several statutes, it is clear that the "two" were printed as a whole and are not separate works, although they are sometimes catalogued as if they were and are even sometimes sold as such. Printed mostly in roman type with some italic, this has headings in gothic and some long passages also in gothic. Provenance: 18th-century ownership signatures at top of main title-page of J.W. Tarleton and J. Skynner (both lined through), and 19th-century signature of Wm. Saunders. Oldham Free Public Library (Lancs.) stamp on verso of same.
