Volume II is entitled: Ordo Judiciorum; Seu Formularium in Negotiis et Litibus in Foro Ecclesiastico-Civili. Oughton "was a learned man, who spared no pains to produce a book which was scientific, accurate, and historically correct. He consulted public and private muniment rooms, the records of the courts, the Cottonian MSS., and the MSS. in the Harleian library. The result of these labors was a book in two volumes, the first of which describes the practice of the ecclesiastical courts, and the second contains a collection of formularies. After the book had been finished and sent to the printers, the printing office and the MS. was destroyed by fire. But Oughton, being, as he said, 'ardens et tenax,' rewrote it. His diligence and perseverance were rewarded; for it became the accepted authority on the practice of the ecclesiastical courts." Holdsworth, A History of English Law XII:616.         M. Annaei Lucani Cordubensis Pharsalia : sive belli civilis libri decem : cum scholiaste, hucusque inedito, et notis integris Henrici Glareani, Jacobi Micylli, Joachimi Camerarii, Hugonis Grotii &c

Lugduni Batavorum: Apud Samuelem Luchtmans, 1728. - "A very excellent edition; it contains the ancient Scholia, the select notes of various ancient and modern editorsÉwith the editors's own remarks and annotations, in which he has explained the subject of his author in a concise and perspicuous manner" (Dibdin). Thick quarto. [74], 966, [194] pp. Engraved frontispiece, engraved folding map, title-page in black and red. Full contemporary black straight-grained morocco. Covers and spine ruled in gilt, all edges gilt, gilt turn-ins, marbled endpapers. First few leaves and frontispiece lightly foxed. A fine copy in a handsome binding. Pharsalia, LucanÕs (39-68 A.D.) great heroic poem on the struggle between Caesar and Pompey after the crossing of the Rubicon, enjoyed great popularity during the Renaissance; in fact it was probably even more popular than Virgil. This is one of the two best quarto variorum editions. The other, which appeared in 1740, adds some notes and removes others so that the serious collector would do well to have both. The editor is Frans van Oudendorp (1696-1761), professor of history and Latin eloquence at the University of Leiden, who also produced esteemed editions of Julius Caesar, Suetonius, Obsequens, Apuleius, and others. There are apparently two issues of this work, one intended to be bound as two volumes. In that issue, p. 505 is blank on the verso, and the next leaf is a singleton with a divisional half-title on the recto and p. 506 on the verso. In the present issue, pp. 505 and 506 occupy sides of the same leaf. [Attributes: Hard Cover]

Native American Land Sale, Signed with Totem Marks

1728 - Tateew, Ochangues and Neckarind, Manuscript deed for land in Ulster County, N.Y. to Cornelius Hornbeek and Frederick Shoonmaker, signed by Abraham Gaasbeek Chambers and Gilbert Livingston, countersigned by John Schoonmaker, Anderyes Decker, J. Pruyn, Jr., and Conrad Wieser as witnesses June 15, 1728. Rochester, Ulster Co., N.Y. Deed for land in Ulster County, N.Y., signed by three Indians with their totem marks and red wax seals, conveying a mine and 400 acres of land to Cornelius Hornbeek and Frederick Schoonmaker. Partial Transcript ".We Tateew, Ochangues and Neckarind, Indians, and native owners and proprietors of a Certaine Tract of Land - situate, lyeing and being in Rochester in the County of Ulster in the Province of New York . . . for divers good and vallueable considerations . and Especially for and in Consideration of the sum of Tenn pounds Currant Money of the Province of New York to us in hand . do grant bargaine and sell unto the said Cornelius Hornbeck and Frederick Schoonmaker their heirs and Assigns forever all that a certaine mine now found out (now supposed to be lead oar) whether the same be copper, tinn, pewter, Lead or Irone Oar, or whatsoever the same may prove to be hereafter, scituate lyeing and being within Rochester aforesaid on the south side of the Sanborgh's Kill near to a certaine place called Kopenagh Togeather with the quantity of four hundred acres of land to be laid out to comprehend the said mine in such shape and forme as the said Cornelius Hornbeck and Frederick Schoonmaker shall see cause for or think convenient."Historical BackgroundSale of land in the Catskill foothills between three Munsee Delaware Indians and two local Dutch settlers. It is remarkable because of the clear marks and wax pictographs used by the Indians and purchasers to seal the deal on paper. Relations between colonists and Indians were not always characterized by conflict and violence. The years 1715 to 1745 marked a significant era of tranquility in the mid-Atlantic region; not coincidentally, this was also a period of peace between France and Britain in Europe.About the year 1720, the Iroquois Confederacy claimed sovereignty over the Delaware Indians, but this was sometimes contested. At conferences between the Iroquois and colonial agents of New York and Pennsylvania, Iroquois sachems sold lands, some of which were Delaware tribal lands. This confluence of events probably explains the appearance of Conrad Weiser as a signing witness to this document. Weiser was born in Germany and migrated with his father, an indentured servant, to the New York frontier in 1710. When Conrad was 16, his father agreed to a local Mohawk chief's proposal for him to live in his Schoharie Valley village, where he learned the Mohawk language and customs (the Mohawks were the easternmost Iroquois tribe). Over time, he became a trusted emissary between the Iroquois and local settlers, and was later employed by colonial governors in this period when the British government did not conduct or coordinate Indian diplomacy. The Delaware and Mahican Indians of eastern Pennsylvania and southern New York recognized that they occupied a shrinking middle ground between the British colonies, the Iroquois, and New France. Though some families chose to remain in the vicinity of white settlers, others joined new mission communities, such as Stockbridge, Massachusetts and Gnadenhutten, Pennsylvania, while others began to venture west. A great majority of Delaware Indians, angered by what they felt was exploitation at the behest of Iroquoian and colonial diplomats, joined the French side during the French and Indian War in the 1750s.This document is also interesting for its reference to mineral extraction. When it became apparent that the British North American colonies did not possess gold or silver, the colonists largely chose not to explore for rare or valuable minerals. As settlement progressed into the Appal. (See website for full description)

Horn & Schenkling 20145; Landwehr, Coloured plates 182 & 202; Nissen, ZBI 3808 & 3808a. One of the finest and best-illustrated works on butterflies and moths ever published, here together with the continuation by Snellen van Vollenhoven. Work on the publication probably began around 1728 and stopped only two hundred years later, when the author of the third series died in 1928, leaving his work unfinished: A. Brants, Nederlandsche vlinders beschreven en afgebeeld (The Hague, 1905-1928). He published only ten parts of the first volume of the third series, not included in the present set. That unfinished third series contained only 10 plates, while the present two series together contain 600 plates plus the 8 frontispieces where butterflies, moths, larvae and pupae on plants form a lovely frame around the title. Most plates show a single species of butterfly or moth in flight and on a plant, along with the larva and pupa, and many add the egg and further figures with anatomical details. "The most important work on Dutch lepidoptera" (Landwehr). Some annotations and inserted notes. With occasional spotting, but otherwise in very good condition and largely untrimmed, preserving most deckles and with some bolts unopened. Bindings rubbed, some spines damaged. A celebrated and beautifully illustrated lepidopterological classic.

        Plan of the English Commerce

Defoeís ìUniversal Plan of Commerceî[DEFOE, Daniel]. A Plan of the English Commerce. Being a Compleat Prospect of The Trade of this Nation, as well the Home Trade as the Foreign. In Three Parts. Part I. Containing a View of the present Magnitude of the English Trade, as it respects, 1. The Exportation of our Own Growth and Manufacture. 2. The Importation of Merchants Goods from Abroad. 3. The prodigious Consumption of both at Home. Part II. Containing an Answer to that great and important Question now depending, Whether our Trade, and Especially our Manufactures, are in a declining Condition, or no? Part III. Containing several Proposals entirely New, for Extending and Improving our Trade, and Promoting the Consumption of our Manufactures, in Countries wherewith we have Hitherto had no Commerce...London: Printed for Charles Rivington, 1728.First edition. Octavo. xvi, [6, contents], [2, ads], 368 pp. Decorative woodcut head- and tail-pieces and initials.Early nineteenth-century calf by J. Mackenzie, neatly rebacked to style. Gilt single-rule border on covers, board edges decoratively tooled in gilt, turn-ins decoratively tooled in blind, edges stained red, marbled endpapers. Ink stamp of the Devon & Exeter Institution on verso of title. Lending library label of the Devon and Exeter Institution on front pastedown. An excellent copy. Very scarce. Housed in a full morocco clamshell case.In this work, Defoe contends that the several branches of trade and commerce, from the cottage manufacturer to the merchant, were largely unaware of each other. He proposes a scheme to join these differing branches into a ìuniversal plan of commerce.îìThe Commerce of the World, especially as it is now carried on, is an unbounded Ocean of Business; Trackless and unkown, like the Seas it is managed upon; the Merchant is no more to be followíd in his Adventures, than a Maze or Labyrinth is to be tracíd out without a Clueî (p. vii).He concludes with a plea for colonial expansion: ìMore Colonies then is, without Question, extending the Commerce; it is enlarging the Field of Action; it calls in more Hands to assist in the Publick Prosperity; it employs profitably the unprofitable Numbers of your Poor, and lays a Foundation of an extended Trade, and thereby of a still larger Exportation from Homeî (p. 366).ìThis work is full of information...It is ably written, and contains sundry passages in which the influence of trade and industry in promoting the well-bein of the labouring classes and the public wealth is set in the most striking point of viewî (McCulloch, p. 45).Goldsmithsí 6594.         The chonology of ancient kingdoms amended

London: J. Tonson . . . J. Osborn and T. Longman, 1728. 226 x 172 mm. Paneled calf c. 1728, gilt edges, rebacked, corners a little worn. Minor foxing and toning but very good. Owner&#146;s inscription dated 1768 on p. iii.</p><p>First Edition, Thick Paper Issue. Newton&#146;s last work, published posthumously the year after his death. In his final years Newton devoted himself primarily to theological questions, particularly to the reconciliation of biblical chronology with classical history. The Chronology of Ancient Kingdoms Amended, which Newton had worked on since the 1690s, had as its purpose &#147;the establishment of a relationship between the observed movement of the earth with respect to the fixed stars and ancient political events, so that the past might be &#145;predicted&#146;&#151;backwards, so to speak&#148; (Manuel, Newton as Historian, p. 68). &#147;In order to square the chronology of ancient kingdoms with his account of the development and diffusion of arts and of idolatry among the descendants of Noah, [Newton] had found it necessary to lop off the antiquity to which most ancient societies had pretended, and among other things he had cut about four hundred years out of the accepted chronology of Greek history&#148; (Westfall, Never at Rest, p. 805). Newton was thus able to &#147;prove&#148; that the Jews were more ancient than the Greeks, as indicated in biblical chronology. Babson 214.</p>

He was best known for his grandiose frescoes using illusionistic technique called quadratura, in which architecture and fancy are intermixed. His masterpiece is the nave ceiling of the Church of Sant'Ignazio in Rome. Through his techniques, he has become one of the most remarkable figures of the Baroque period. He is also noted for the architectural plans of the Ljubljana Cathedral (1700), inspired by the designs of the Jesuit churches Il Gesù and S. Ignazio in Rome. (Wikipedia).         The History of Japan : giving an account of the antient and present state and government of that empire; of its temples, palaces, castles, and other buildings; of its minerals, trees, plants, animals, birds and fishes; of the chronology and succession of the emperors, ecclesiastical and secular; of the original descent, religions, customs, and manufactures of the natives, and of their trade and commerce with the Dutch and Chinese. Together with a description of the kingdom of Siam

London: Thomas Woodward and Charles Davis, 1728. Two volumes, folio, with an engraved additional title (dated 1727) and 45 plates and maps, many folding (a couple of clean tears); titles printed in red and black; contemporary panelled calf, spines gilt; neat old repairs to spines. Kaempfer&#39;s handsome and definitive work. An excellent and very attractive copy of this exceptionally important book on Japan. Kaempfer sailed from Batavia via Siam as a physician with the Dutch East India Company and reached Japan in late 1690. Although much of his two-year sojourn was spent on the island of Deshima, to which the Dutch merchants were confined by the strict orders of the Tokugawa regime, he was twice able to accompany the annual Dutch embassy from Nagasaki to the Shogun&#39;s court at Edo (Tokyo). After his death in 1716 Sir Hans Sloane bought his botanical collections and library, including the unpublished manuscript of the History of Japan, which was translated into English by Sloane&#39;s librarian, J.G. Scheuchzer, and published in 1727 under the aegis of the Royal Society. The English edition of Kaempfer&#39;s book is therefore its first appearance in print in any language. The History of Japan was &#39;for more than a century the chief source of Western knowledge of the country. It contains the first biography of Kaempfer, an account of his journey, a history and description of Japan and its fauna, a description of Nagasaki and Deshima; a report on two embassies to Edo with a description of the cities which were visited on the way; and appendixes on tea, Japanese paper, acupuncture, moxa, ambergris, and Japan&#39;s seclusion policy&#39; (DSB). The Second Appendix, present in this issue, recounts the unsuccessful attempt of the English East India Company in 1673 to re-open direct trade with Japan after a lapse of 50 years. This very attractive copy is an example of the first edition, in its second and best issue which has an extra Second Appendix containing &#39;part of an authentick journal of a voyage to Japan, made by the English in the year 1673&#39;. This was not included in the original version of the book issued in 1727. This edition is otherwise a re-issue of the 1727 sheets with new title-pages (dated 1728) which specify the addition of the journal - which has its own title-page, dated 1728, and preface. Both volumes of the present copy have a 1728 title-page; some copies of the edition have a 1727 title-page in the second volume. Here the engraved title to the first volume retains its 1727 date.

There is a short list of French steps with their contemporary Italian equivalents (p. 27), and a brief account of the Menuet (p. 117). The explanations are accompanied with simple stenochoregraphic notations (Feuillet system)." Beaumont "An important book on the dance of the time, giving the names of the steps in French and Italian, and very good descriptions." Derra de Moroda "By publishing this manual for the use of his pupils in Naples, the French trained dancing master Dufort helped disseminate French dance abroad by providing Italian equivalents for French dance terms... Using the dance notation known as chorégraphie, as well as verbal description, he discusses the five positions and problems of coordinating movement with music. He then briefly explains chorégraphie in order to use it further in describing steps... Information on the use of arms, the performance of bows, tracing the floor pattern, and the cultivation of style close this section... The treatise on the minuet is similarly organized. A final section treats briefly the contredanse... and bows other than in dancing..." Schwartz & Schlundt 17
