*-------* Third edition, but "a re-issue of that of 1659, itself a re-issue of the 1612 edition, but with a new preface and supplement containing Ripley's Traité du mercure which occupies pp. 96-106." (Duveen 28). With a plate of Flamel's hieroglyphics et 8 wood engravings in-text. Ferguson 48 : "Most of copies I have examined have been imperfect, damaged, stained or dirty." This one is complete and in very good condition. In-4. Collation : 106 pp. Veau marbré, dos à nerfs orné, tranches dorées. (Reliure du XVIIIe.).

The Most Excellent Hugo Grotius, His Three Books Treating of the Rights of War & Peace.

London: for Thomas Basset and Ralph Smith,, 1682. In the First is handled, Whether any War be Just. In the Second is shewed, The Causes of War, both Just and Uujust [sic]. In the Third is declared, What in War is Lawful; that is, Unpunishable. With the Annotations digested into the Body of every Chapter. Quarto (310 x 203 mm). Contemporary calf, raised bands, frame to boards in blind, gilt roll to board edges, edges marbled. With the additional engraved vignette title page with portraits of Grotius and Evats by Thomas Cross facing the title page, the latter printed in black and red. Very light rubbing to extremities, professional repairs to spine ends and joints, lower corner of front board and board edges, small nick to p. 485, an excellent copy. First complete English edition of the Dutch philosopher, jurist, and theologian's legal masterpiece, De Jure Belli ac Pacis Libri Tres, first published in Paris in 1625. Considered to be the first expression of the "droit naturel", the first theorisation of "just war", and the foundation of modern international law, it had a profound influence on eighteenth-century political theorists such as Locke as well as on the arguments which supported the Glorious Revolution and the American Revolution. In his treatise Grotius puts forth his definitions of war and natural law (Book I), then argues for the identification of three just causes for war (Book II), and finally examines whether war and its combatants are bound by rules (Book III). "The questions which he put forward have come to be the basis of the ultimate view of law and society. This was the first attempt to lay down a principle of right, and a basis for society and government, outside Church or Scripture" (PMM). There had been one previous English translation prepared by Clement Barksdale (1654) which was considered by later translators a "small and worthless abridgment" (Nolan and Robertson p. 190).

All three volumes bound in one contemporary full mottled calf with five raised bands to richly gilt spine. Wear to hinges and corners, but fine and tight. Old catalogue entries taped in to inside of front board and front free end-paper with a re-enforcement to hinge and a tape-strip down the middle. A few leaves with small marginal tears, and one plate (the second in vol. II) with a closed tear. One further plate with a small tear and one leaf with a small marginal repair. 140; (4), 136, (4); (8), 132, (2) pp. Richly illustrated throughout, with ab. 150 large engravings (many double-full-page), in good impressions (which is very rare for the present work). The collation is quite confusing, as all the illustrations are part of the pagination, also the full-page plates; furthermore, the plates are only paginated on one side. The full collation follows below. Vol. I: Engraved title-leaf with hunting scenes, title-page, pp. 3-5: Dedication for King Christian V, pp. 6-16: Preface, pp. 17-140: the text, with illustrations, containing 114 engravings in the text (almost all ab. 1/3 page) and 10 double-page engraved plates (numbered on one side only).Vol. II: Engraved title-leaf (with different motiv than the first), title-page printed in red and black, pp. 1-2: Dedication to Prince Frederich, pp. 3-136: the text, with 15 double-page engraved plates (numbered on one side only), followed by two unnumbered leaves of index. Vol. III: Engraved title-leaf (differeing from the two others), title-page printed in red and black, three unnumbered leaves with: Dedication for King Christian V (five pages) and preface (1 page), the text is paginated pp. 3-132, with 14 double-page engraved plates (numbered on one side only), followed by one unnumbered leaf of index (Thesaurus mentions only 10 plates and no index). The exceedingly scarce first edition, first issue of all three parts of one of the most important hunting books ever printed, being one of the most original hunting books of all time, the most comprehensive German book of hunting from the 17th century, and the first book on hunting printed in Denmark. The magnificent and very richly illustrated work, paid for by the author himself, is one of the most interesting, curios and original books of its kind ever published. As opposed to virtually all other litterature on hunting from the period, Täntzer's great work is not based upon any other sources whatsoever. It is much more than the usual compilation of earlier material on the subject with some added obesrvations, which is normal for the period; it is that rare gem of a wholly original work on hunting. As such, it occupies an almost unique position, and as Lindner states is "unparallelled in hunting litterature" ("ohne Parallelle im Jagdlichen Schrifttum - Lindner, p. 92). Täntzer's sole purpose ist to disseminate his own empirically gathered knowledge according to his personally developed, original system. Every single word (apart from a few references tot he Bible) are his own, and as such, the work is totally unique. The work also contains an original list of technical hunting terms that is of great importance to the history of hunting terms. The greater second part of volume one constitutes a very amusing and comprehensive scientific survey of hunting animals, in which all hairy animals are originally described by Täntzer. "Wir haben mit diesen Kapitels des Täntzerschen Werkes eine wirklich reichhaltige, im Gegensatz zu anderen Partien recht lebendig geschriebene, oft von eigenen Erlebnissen und Feststellungen gewüzte originelle Jagdtierkunde vor uns." (Lindner, p. 94).The second part of the work is also of the greatest importance to hunting history, as it is here that Täntzer describes the tools and techniques used for hunting. Before Täntzer, these had only been very sparsely and ramdomly described, whereas Täntzer describes them extremely thoroughly and thus creates a whole new part of hunting litterature. As Lindner writes, Tänntzer has erected a monument for all later ages, "as no history of German hunting technique in the 17th century can be written without constantly taking into consideration Täntzer's testimony. With an unparallelled thoroughness, Täntzer describes all kinds of nets and other materials and tools used for the hunting of game, predators, wolves, foxes, hares, rodents, etc., and he thorougly instructs on the use, application, measuring, manufacturing, and care of all these hunting materials. The same applies to traps for bears and all other imaginable hunting equipment. This unparalleled treatment of hunting equipment is of the greatest importance to the history of hunting. As stated by Lindner "we know of no other depition in European hunting litterature at any time throughout the ages, which is comparable to Täntzer's treatment in regard to detail and pecision." - Lindner, p. 95).Part three consists partly in a thorough description of hunting dogs and partly (chapters 18 to 95) in a thorough description of Täntzer's self-developed and wholly original kind of "perforce"-hunting. The illustrations for the first part are mainly by Antony Mathysen and those for the two other parts are by Frederik Ernst Wedel. The impressions are of very varied quality and many copies have very weak prints. In fact, some of them were so weak, that in many copies Täntzer inserted stronger impressions covering the weaker ones. The first edition of the work - especially the first part - is of the utmost scarcity. The first part in the original 1682-priniting, printed in Copenhagen, was printed in small numbers and seems to have quickly sold out. In 1686 and 1789 respectively, parts two and three appeared, and in 1699 a second edition of part one appeared, printed in Germany, presumably to be sold with the first editions of the two latter parts. Thus, almost all known copies of the work have the first part in the inferior second edition. In the second edition, the text has been separated from the illustrations, and it does not measure up to the first edition in neither beauty nor whole. The second edition also has fewer illustrations, as some of them were omitted. In 1734 a new edition appeared, also printed in Germany, being the third edition of the first volume and second edition of volumes two and three. Although also very sought-after, this edition is inferior to the first, as it completely alters Täntzer's carefully chosen layout of the work and omits his personal commentaries that accompanied the first edition.         Short Treatise Touching Sheriffs Accompts

1682. First Edition . (BROWNE, Thomas) HALE, Matthew. Short Treatise Touching Sheriffs AccomptsÂ… to which is Added, a Tryal of Witches, at the Assizes held at Bury St. Edmonds, for the County of Suffolk, on the 10th of March 1664. London: Will. Shrowsbery / William Shrewsbery, 1683 / 1682. Small octavo, contemporary full brown sheep rebacked, red morocco spine label, raised bands. $4200.First edition of A Tryal of Witches on the notorious witchcraft trial at Bury St. Edmonds, one of the key witchcraft trials of the 17th century, a psychiatric and legal cornerstone so influential that ""the Salem witch-hunts might not have taken place if there had not been a trial at Bury St. Edmonds."" In one volume with Hale's 1683 Short Treatise Touching Sheriffs Accompts.According to the charges listed in Tryal of Witches, Rose Cullender and Amy Drury, two elderly widows, had caused children to become suddenly and violently ill, to vomit nails and pins, and to see mice, ducks, and flies invisible to others. Additionally, a toad was alleged to have run out of the bed of the young mother of one of their victims. When thrown into the fire, the toad ""made a great and horrible Noise, and after a space there was a flashing in the Fire like Gun-powder, making a noise like the discharge of a Pistol, and thereupon the Toad was no more seen nor heard"" (6). The pair was ultimately hanged, though neither confessed to being a witch. The case ""strongly influenced the most notable of America's witchcraft prosecutions, the Salem trials of 1692. Indeed, the Salem witch-hunts might not have taken place if there had not been a trial at Bury St. Edmonds: the events at Salem notoriously imitated those at Bury. Cotton Mather in his Wonders of the Invisible World included a large number of excerpts and interpretations of the Bury trial in order to justify what happened at Salem"" (Bunn & Geis 7). Sir Thomas Browne, a noted physician to whom Tryal of Witches has been attributed, played a principal role as the prosecution's medical expert. In his earlier writings, specifically Religio Medici (1642), Browne asserted during the Bury St. Edmonds assize that ""the persons were BewitchedÂ… [since] the Devil in such cases did work upon the Bodies of Men and WomenÂ… to stir up, and excite such humours super-abounding in their Bodies to a great excess""(41). Hale, whose Short Treatise is in the same volume, was a highly respected and influential jurist. ""In his statement to the jury, Hale made no doubt at all of the reality of witchcraft, citing the Scriptures and the laws enacted against witchcraft as proof of its existenceÂ… Browne's testimony in support of the reality of witchcraft may be the first documented example of expert testimony by a physician in reference to a psychiatric issue. His testimony also played a role in the Salem witch trials, as Cotton Mather quoted it to allay the doubts of those who challenged the reality of witchcraft"" (Norman Library 966). Hale's Short Treatise Touching Sherriffs Accompts separately issued the same year, no priority established. Bound in one volume as issued with first edition of Tryal of Witches containing separate 1682 title page. Wing H260. ESTC R14358. Text generally fresh and clean, light rubbing and early repairs to boards. An extremely good copy.

        English Liberties

1682. First Edition . (CARE, Henry). English Liberties: Or, The Free-Born Subject's Inheritance. Containing I. Magna Charta, The Petition of Right, the Habeas Corpus Act… II. The Proceedings in Appeals of Murther; The Work and Power of Parliaments… As also the Oath and Duty of Grant and Petty Juries. III. All the Laws against Conventicles and Protestant Differeters… And an Abstract of all the Laws against Papists. London: Printed by G. Larkin, for Benjamin Harris, [1682]. Small octavo (3-1/2 by 6 inches), contemporary full polished brown sheep rebacked with original spine laid down, later red morocco spine label. Housed in a custom clamshell box. $16,000.Rare first edition, containing printings of the Magna Charta and other seminal documents on the separation of church and state, the right to religious liberty, trial by jury and other founding principles. It was designed to ""slip into one's pocket… [and] had more to do with preparing the minds of American colonists for the American Revolution than the larger but less accessible works of Coke, Sidney and Locke"" (Hudson, 580-85). Care's influence is clear ""in the writings of the founding fathers of the United States—Samuel Adams, John Adams, John Dickinson and Alexander Hamilton… Jefferson added two copies of English Liberties to his library and arranged that it be included in the library of the University of Virginia"" (Schwoerer, 231-5). A handsome copy in contemporary sheep. Care's English Liberties contains ""the most important documents and statements in English history and law concerning liberty, property and the rights of the individual… Benjamin Franklin knew its contents thoroughly"" (Lemay, Life, 74). This first edition features a printing of the Magna Charta, ""a symbol of political liberty and the foundation of constitutional government"" (Grams, Great Experiment, 95), and was published in 1682 ""to provide uneducated and inexperienced English persons with documents and information about the law and their rights… praising England's 'fundamental laws [as] coeval with government' and describing the Magna Charta as 'Declaratory of the principal grounds of the Fundamental Laws and Liberties of England.' Celebrating law in another piece as second only to the gospel, he described it in English Liberties as 'the Best Birthright the Subject hath'… Care regarded the essence of this birthright as the 'privilege not to be exempt from the law of the land, but to be freed in Person and Estate from Arbitrary Violence and Oppression'"" (Morrison & Zook, Revolutionary Currents, 46-7). ""Care advocated a radical theory of liberty of the religious conscience for all persons… and argued for the principle of separation of church and state… his ideas are comparable to those of John Locke on that subject and were in print before Locke's Letter on Toleration."" Care especially promoted ""an abiding respect for the merits of trial by jury as a bulwark of English rights and liberties. English Liberties… helped to transmit this 'jury ideology' and other ideas about fundamental laws and the rights and liberties of Englishmen to 18th-century England and the American colonies"" (Schwoerer, Ingenious Mr. Henry Care, xxvi). On publication, English Liberties ""became a publishing phenomenon, with successive editions circulating around the Atlantic world in the 18th century, its small size—it could literally fit into a pocket—enabling knowledge of English rights to reach the peripheries of the empire"" (Yirush, Settler, Liberty and Empire, 29). It is said to have ""had more to do with preparing the minds of American colonists for the American Revolution than the larger but less accessible works of Coke, Sidney and Locke"" (Hudson, William Penn's English Liberties, 585).In America, English Liberties ""played an important role in spreading concepts about English law, history, government, liberties and especially juries… Colonists found in Care's English Liberties support of their views about the Saxons' Magna Charta as a reaffirmation of old laws guaranteeing the rights of all freemen, and ways to protect themselves against oppression… Care's vocabulary and ideas appeared in the writings of the founding fathers of the United States—Samuel Adams, John Adams, John Dickinson and Alexander Hamilton. In their speeches and writings may be found exactly the same language that Care used in English Liberties when he praised the 'two main pillars of the British Constitution,' identifying those pillars as parliament and trial by jury… Americans started with Care's statement that the 'two Grand Pillars' of an Englishman's birthright shone 'most conspicuously in Parliament and juries' and reasoned from it that since the Constitution was 'founded in the Common Rights of Mankind,' and since the 'Rights of Nature' were 'happily interwoven' in its 'ancient fabrick,' the right to parliament and juries was 'properly the birthright of free men everywhere'… Care's ideas, like those of William Penn and John Locke, which they profoundly resemble, were ahead of their time… Penn silently lifted a sizable portion of English Liberties… into his Excellent Priviledge [sic] of Liberty and Property, which was printed in Philadelphia in 1687… The Library Company of Philadelphia, founded in 1731 by Franklin, acquired the 1719 [English] edition of English Liberties in 1764… Jefferson added two copies of English Liberties to his library and arranged that it be included in the library of the University of Virginia"" (Schwoerer, 231-5). Care and his publisher Larkin, who was also William Penn's printer, were frequently threatened not only with arrest and imprisonment, but also with physical injury. Many of Care and Larkin's publications were seized by the authorities and Care ""was called before government authorities for seditious libel five times between 1679 and 1685"" (ODNB). ""In 1689, seven years after the publication of… English Liberties, Parliament presented King William III and Queen Mary a declaration that became known as the Bill of Rights… In the colonies, as in England itself, Americans would celebrate English liberties as their birthright"" (Davis, Mintz et al., Boisterous Sea of Liberty, 83). With woodcut-engraved headpiece and initial. Larkin printed three 228-page issues of the first edition with variant title pages, no priority established: two with no imprint date on the title pages: one ""for John How"" and one ""for Benjamin Harris"" (this copy) along with one with the imprint date of 1682 on the title page for ""most Booksellers."" Schwoerer, Ashcraft and others attribute the anonymously published English Liberties to Care, while some cite Penn as author. Ashcraft offers, as support, ""an advertisement for English Liberties in the September 2-6, 1862 issue of the True Protestant Mercury [that] makes it likely it appeared in late August of that year"" (Morrison & Zook, 205n). Wing SCT ""gives the date as '1862(?)' but internal and other evidence shows incontrovertibly that the date is 1682"" (Schwoerer, 288n, 194). Precedes the 1721 first American edition. Bound without initial blank leaf, two-leaf publisher's advertisement; page 191 mispaginated as issued. ESTC R31286. See Sowerby 2702, 2703; Sweet & Maxwell I:154-55; Sabin 10819. Bookplate of bibliophile Robert J. Hayhurst. Small shelf label. Plain bookplate with trace of owner signature.Faint dampstaining to text and front board, a bit of marginal wormholing. A near-fine copy of this profoundly influential work.

Utrecht, G. de Walcheren, 1682. Small-4to. pp. (8), 215, (1), with woodcut title-vignette, 1 folded table and 13 (10 folded) engraved plates. Contemporary boards, spine with 2 red gilt lettered labels. Hagen II, 209; Horn & Schenkling 21794; Nissen ZBI, 4054. First French edition; the original Dutch edition was published in 1669, entitled 'Historia Insectorum generalis'. "Swammerdam's thesis about insects was fundamentally new and significant. For his contemporaries, as for Aristotle, there existed three good arguments, that not only placed the insects far from the higher animals, but even tended to remove them from the realm of subjects open to scientific study. These arguments were: insects lack internal anatomy; they originate by spontaneous generation; and they develop by metamorphosis. Swammerdam believed that all three arguments were false and devoted a wide variety of investigations to refute these ideas" (D.S.B. XIII, pp. 168-175). One leaf with 2 small tears.
